The reader Phan Ngọc Tú inquires, in 2020, did you transfer 1 vehicle automobile to another person and agreed that the buyer would proceed with the procedures for registering ownership of the aforementioned automobile.
However, to date, the buyer of the vehicle has not completed the procedures for registering ownership. Reader Tú inquires the Ministry of Public Security:
- In the case where the procedures for registering ownership have not been completed to date for the vehicle I sold, is the license plate number of the vehicle considered to be the identification number of reader Tú?
- According to the agreement of transfer, if the buyer of the vehicle has not completed the procedures for registering ownership, is there a violation of the law? If there is a violation, how will it be handled? What should reader Tú do to transfer the ownership to the buyer of the vehicle?
The Ministry of Public Security replied to this content on August 7 on the Electronic Information Portal:
Article 39 of Circular No. 24/2023/TT-BCA dated July 1, 2023 of the Ministry of Public Security, regulating the issuance and revocation of vehicle registration and license plates (effective from August 15, 2023), stipulates:
- For vehicles registered with a 5-digit license plate number prior to the effective date of this Circular and have not yet completed the procedures for revocation, the license plate number is considered to be the identification number of the vehicle owner (paragraph 1).
- For vehicles registered with a 3 or 4-digit license plate number, they are still permitted to participate in traffic, except in cases where the vehicle owner wishes to obtain a identification license plate or when the vehicle owner completes the procedures for issuing a new vehicle registration certificate, replacing the license plate, or registering the vehicle's ownership transfer, as stipulated in this Circular, then the 3 or 4-digit license plate number is revoked and replaced with an identification license plate (paragraph 4).
Paragraph 4 of Article 6 of Circular No. 24/2023/TT-BCA stipulates: Within 30 days from the date of completing the procedures for transferring vehicle ownership, the vehicle owner must complete the procedures for revocation; if the vehicle owner fails to complete the procedures for revocation or transfers the vehicle registration certificate and license plate to the organization or individual receiving the vehicle ownership, the registration authority shall issue a decision to impose a fine on the vehicle owner for failing to complete the procedures for revocation (The fine is stipulated in point c, paragraph 7 of Article 30 of the Government's Decree No. 100/2019/NĐ-CP dated December 30, 2019 (amended and supplemented by Decree No. 123/2021/NĐ-CP dated December 28, 2021) regulating the handling of administrative violations in the field of road and rail transportation).
