Principles of using public assets to contribute capital to commercialize scientific research results

The Lao Dong Newspaper Legal Consulting Office replied:

Clause 2, Article 4, Decree 271/2025/ND-CP (effective from October 15, 2025) Regulating the establishment, participation in the establishment of enterprises, participation in contributing capital to enterprises to commercialize the results of scientific research and technology development in Hanoi City, stipulates the principles of using assets of public establishments to contribute capital as follows:

a) Ensure the correct purpose for commercializing the results of scientific research and technology development under the intellectual property rights of that facility itself;

b) Exploit and use assets publicly, transparently and in accordance with the provisions of law;

c) Fully fulfill its obligations regarding taxes, fees, charges and other financial obligations to the State as prescribed by law;

d) Not used to contribute capital to secret patents, land and security and defense works, other assets that are not used to contribute capital;

d) In case it is necessary to determine the value of assets to contribute capital, it must be transparent, public and in accordance with the provisions of law;

e) Implement the regime of reporting the business performance and results of enterprises to commercialize the results of scientific research and technology development under the intellectual property rights of public establishments and under the supervision of competent authorities according to the provisions of law.

Thus, the use of public assets when contributing capital to commercialize the results of scientific research is based on the above principle.
