The problem of our social housing is also very "hot" today, especially in big cities such as Hanoi, Ho Chi Minh City and industrial parks.
On October 10, 2025, the Government issued Decree No. 261/2025/ND-CP amending and supplementing a number of articles of Decree No. 100/2024/ND-СР dated July 26, 2024 of the Government regulating a number of articles of the Housing Law on the development and management of social housing and Decree No. 192/2025/ND-CP dated July 1, 2025 of the Government regulating a number of articles and measures to implement Resolution No. 201/2025/QH15 dated May 29, 2025 of the National Assembly on a number of specific mechanisms and policies for the development of social housing.
Accordingly, Clause 2, Article 1 of Decree No. 261/2025/ND-CP has amended and supplemented Clause 1 and Clause 2, Article 30 of Decree No. 100/2024/ND-CP as follows:
"Article 30. Income conditions
1. For subjects specified in Clauses 5, 6 and 8, Article 76 of the Housing Law, the following income conditions must be ensured:
a) In case the plaintiff is unmarried or confirmed single, having an actual average monthly income of not more than 20 million VND shall be received according to the Salary and Salary Table as confirmed by the agency, unit or enterprise where the subject works. In case the petitioner is an unmarried person or is confirmed to be single and raising a child under the age of majority, the actual average monthly income received shall not exceed 30 million VND as calculated in the Salary Table, confirmed by the agency, unit, or enterprise where the subject works.
b) In case the plaintiff is married according to the provisions of law, the plaintiff and his/her husband (husband) with a total average monthly income shall receive no more than 40 million VND in equity according to the Salary and Salary Table confirmed by the agency, unit, or enterprise where the subject works...".
Thus, according to the new regulations, the income condition when purchasing social housing has been adjusted from 15 million VND to 20 million VND for single people who are not married; up to 30 million VND for single people who are raising children under the age of majority; up to 40 million VND for single people and their spouses with a total average monthly income actually calculated according to the Salary and Salary Table to match the current rising living expenses.
That is the first condition.
The second condition is to meet housing conditions. Accordingly, social housing buyers are not allowed to have their names on any real estate in the province or city where there is a social housing project. Or, if you already have a house, the average area per capita in the household must not exceed 15m2/person at the permanent residence.
Currently, according to the Housing Law, the condition of residence has been removed. This regulation is to be more consistent with citizens' right to free residence.
Previously, the regulation required the registered candidate to have a permanent or temporary residence in a social housing project, but now this regulation has been abolished. This is a point that needs to be paid close attention to.
