Lao Dong Newspaper Legal Consulting Office replied:
Article 15 of the 2024 Trade Union Law (amended), effective from July 1, 2025, stipulates participation in inspection and examination of the activities of trade union agencies, organizations, units and enterprises as follows:
1. Trade unions are responsible for participating in and coordinating with competent state agencies to inspect and examine the implementation of regimes, policies and laws on trade unions, labor, employment, wages, cadres, civil servants, public employees, social insurance, unemployment insurance, health insurance, occupational safety and hygiene and other regimes, policies and laws related to the rights and obligations of employees.
2. When inspecting and examining contents directly related to the legitimate rights and interests of employees and trade unions, competent state agencies have the responsibility to invite trade union representatives to participate.
3. When participating in inspections and audits, the Trade Union representative has the duties, powers and responsibilities in accordance with relevant legal provisions and the following rights and responsibilities:
a) Request agencies, organizations, units and enterprises to provide information, documents and explain issues related to the content of the inspection;
b) Proposing measures to prevent, correct, remedy consequences and handle violations of the law;
c) Require responsible agencies, organizations, units, enterprises and individuals to immediately take remedial measures to ensure occupational safety and hygiene, including temporarily suspending operations in case of detecting workplaces with harmful or dangerous factors to the health and lives of workers.
Thus, the participation of trade unions in inspection and examination is regulated as above.
