Authority to transfer teachers according to new regulations

Clause 1, Article 11 of Decree 93/2026/ND-CP (effective from March 31st) detailing and guiding the implementation of a number of articles of the Law on Teachers stipulates the authority to transfer as follows:

a) The Chairman of the Commune-level People's Committee exercises the authority to transfer teachers, teachers holding educational institution management positions from this public educational institution to another public educational institution under management authority; from educational institution to commune-level educational management agency under management authority;

b) The Director of the Department of Education and Training exercises the authority to transfer teachers, teachers holding educational institution management positions from this public educational institution to another public educational institution under management authority; from this educational institution to another educational institution under the management authority of 02 different commune-level administrative units; from public educational institutions in the province to provincial-level educational management agencies;

c) The Minister of National Defense, the Minister of Public Security regulate the mobilization of teachers in schools of the people's armed forces;

d) For educational institutions not falling under the cases specified in points a, b and c of this clause, the competent authority managing the educational institution decides on the authority to transfer teachers under its management;

e) Provincial People's Committees shall, based on the provisions of this Article, relevant legal regulations and the actual conditions of the locality, issue regulations on teacher mobilization to organize the implementation of teacher mobilization for cases specified in points a and b of this clause. The regulations on teacher mobilization specifically stipulate the subjects, time limits, time of teacher mobilization and other related contents in accordance with actual conditions.

e) The competent authority to transfer teachers specified in point d of this clause specifies the subjects, time limits, time of transfer of teachers and other related contents in accordance with actual conditions.

Thus, from March 31, 2026, teachers will be transferred according to the above authority.
