The Lao Dong Newspaper Legal Consulting Office replied:
Clause 2, Article 5, Circular 14/2024/TT-BCA stipulates: Adjustment increases, decreases the number of members, the number of security and order protection teams prescribed at Points b, Clause 1 and Clause 2, Article 17 of the Law on Forces participating in security and order protection at the grassroots level: Based on the decision of the provincial People's Committee on increasing and decreasing the number of members, the number of security and order protection groups for the following regulations
a) In case of increasing the number of members, increasing the number of Security and Order Protection Teams, the provisions of Articles 3 and 4 of this Circular shall apply;
b) In case of reducing the number of security and order protection groups: The commune -level police shall assume the prime responsibility for, and coordinate with the head of the village, the head of the residential group, the head of the Front Task Force in the village or the residential group shall report to the President of the People's Committee of the same level to issue a decision to dissolve the security and order protection team.
Within 05 working days from the date of receiving the document of the commune -level police, the Chairman of the People's Committee of the commune shall consider and decide to dissolve the security and order protection team (Form No. 08 of the Appendix attached to this Circular) and assign the commune -level police to publicly decide at the People's Council's headquarters, the People's Committee, the commune -level police, at the cultural house and the community activities in the village.
The reduction in the number of members of the Security and Order Protection Team is carried out according to the roadmap and in accordance with the number of members of the Security and Order Protection Team that has been adjusted by the Provincial People's Committee.
Thus, the Chairman of the People's Committee at the commune level has the right to decide to dissolve the Security and Order Protection Team at the grassroots level.
