The Lao Dong Newspaper Legal Consulting Office replied:
Article 64, Decree 102/2024/ND-CP stipulates the order and procedures for extending land use when the land use term expires as follows:
1. Within the time limit prescribed in Clause 3, Article 172 of the Land Law, the land user needs to extend the land use expiration when the land use term is expired, submit 01 set of dossiers of application for an extension of land use at the agency receiving the dossier and return the results specified in Clause 1, Article 12 of this Decree. The dossier includes an application for land use extension according to form No. 08 in the Appendix issued together with this Decree and one of the following documents:
a) One of the certificates specified in Clause 21, Article 3, Clause 3, Article 256 of the Land Law;
b) Land allocation decisions, land lease decisions, decisions allowing change of land use purpose by competent state agencies in accordance with the provisions of the law on land through the periods;
c) Documents from competent authorities allowing an extension of the investment project's operating period or showing the investment project's operating period according to the provisions of the law on investment in cases of land use to implement investment projects.
2. Order and procedures for extension of land use shall comply with the provisions of Clauses 2, 3, 4 and 6, Article 44 of this Decree. The content of the decision to renew land use according to Form No. 04E in the Appendix issued together with this Decree. In case the land user does not require a new certificate, the Land Registration Office or Branch of Land Registration Office shall certify the change of land use term on the issued certificate, transfer it to the dossier receiving agency and return the results specified at Point a, Clause 1, Article 12 of this Decree to pay to the land users.
Thus, the procedure for extending land use when the land use term expires is regulated as above.
