The draft Law on Organization of Local Government (amended) has just been submitted by the Government to the National Assembly for consideration at the 9th Extraordinary Session.
The draft has many amendments and supplements in the direction of expansion and clearly stipulates the decentralized subjects and the decentralized subjects, the authorized subjects and the authorized subjects (Articles 14, 15).
Implementing the principle of "clear people, clear work, clear responsibilities", the draft law defines the tasks and powers of the People's Committee (UBND) and the Chairman of the People's Committee where the local government is organized in the direction of increasing the tasks, authority, and responsibility of the Chairman of the People's Committee.
The Chairman of the Provincial People's Committee shall lead and manage the work of the People's Committee; convene and chair meetings of the People's Committee; lead and direct the implementation of tasks of implementing the Constitution, laws, documents of superior state agencies and of the People's Council and People's Committee at his level; inspect and handle violations in the process of implementing the Constitution and laws in the locality.
Lead and be responsible for the operation of the state administrative apparatus in localities; for implementing administrative reform and reforming public services and civil servants in the state administrative system in localities.
Lead, direct, urge and inspect the work of specialized agencies, administrative agencies under the People's Committees at their levels, People's Committees, Chairmen of People's Committees at lower levels in implementing the Constitution, laws, documents of superior state agencies, resolutions of the People's Council and decisions and directives of the People's Committees at their levels.
Direct and organize the implementation of socio-economic development tasks, developing local sectors and fields.
Responsible for organizing the implementation of tasks on national defense, security, social order and safety, foreign affairs activities; protecting assets of agencies and organizations, protecting the lives, freedom, honor, dignity, assets, other legitimate rights and interests of citizens, ensuring human rights; preventing and combating corruption and waste; preventing and combating crimes and other violations of the law in the locality.
Direct and be responsible for effectively managing and organizing the use of facilities, finances and state budget sources allocated in the province in accordance with the provisions of law.
Direct and be responsible for the recruitment and use of civil servants and public employees in the area according to the provisions of law and the decentralization of superior state agencies; decide to appoint, dismiss, transfer, suspend, suspend the work, remove the head and deputy head of professional agencies, other administrative organizations, public service units under the People's Committee at their level.
Direct the implementation of inspection, examination, citizen reception, complaint and denunciation settlement, prevention and combat of bureaucracy, corruption, negativity and waste in the operations of the state administrative apparatus and in local socio-economic activities.
Approving the results of the election, dismissal, removal and decision on transfer, suspension of work, removal from the positions of Chairman and Vice Chairman of the District People's Committee; assigning the authority of the Chairman of the District People's Committee...
Notably, the Chairman of the People's Committee of the centrally-run city shall perform the following additional tasks and powers:
- Direct and organize the implementation of planning, programs, and urban development plans and urban infrastructure in the city in accordance with the provisions of law.
- Direct and organize the implementation of the use of urban land funds to serve the construction of urban infrastructure works in accordance with the provisions of law.
- Direct the inspection of compliance with the law in the construction of houses and construction works in urban areas.
- Responsible for performing the task of managing urban population; preventing and combating social evils in urban areas;
- Responsible for performing the task of managing, protecting space, architecture and urban landscape; organizing and directing the implementation of tasks to ensure public order, traffic safety, and prevent traffic congestion.
