The Lao Dong Newspaper Legal Consulting Office replied:
Clause 1, Article 6 of Decree 59/2023/ND-CP detailing a number of articles of the Law on Grassroots Democracy, stipulates the preparation of village heads and heads of residential groups as follows: The Chairman of the Commune People's Committee is responsible
a) Promulgating the decision to organize the election of village heads, heads of residential groups; Assume the prime responsibility for, and coordinate with the Standing Committee of the Vietnam Fatherland Front Committee of the commune, developing plans, professional guidance and organizing the implementation of the plan within 20 days before the meeting of the meeting of the community to elect village heads and heads of the residential group.
b) Issue a decision to establish an Election Team no later than 10 days before the date of holding a community meeting to elect a village chief or a residential group leader after reaching an agreement with the Vietnam Fatherland Front Committee at the commune level.
The election team includes: Representatives of the Front Working Committee in villages and residential groups as group leaders; members who are representatives of mass organizations, politics - society and representatives of households in villages and residential groups (not candidates for village heads or residential group leaders).
Decisions must be notified to the people in the villages, residential quarters, listed at cultural houses, community houses of the village, residential groups and notified on the radio system or in other forms suitable to the local conditions at the latest at least 07 days before the election date.
Thus, the responsibility of the Chairman of the Commune People's Committee when preparing to elect a village chief is stipulated as above.
