Regulations on removing the position of Chairman of the Commune People's Committee from March 2025

The Lao Dong Newspaper Legal Consulting Office replied:

Article 39 of the Law on Organization of Local Government 2025 (effective from March 1, 2025) stipulates the transfer and removal of the positions of Chairman of the People's Committee and Vice Chairman of the People's Committee as follows:

1. The Prime Minister decides to transfer the Chairman of the People's Committee, Vice Chairman of the Provincial People's Committee; Chairman of the Provincial and District People's Committees decides to transfer the Chairman of the People's Committee, Vice Chairman of the People's Committee at the direct subordinate level.

2. The Prime Minister decides to remove from the positions of Chairman of the People's Committee, Vice Chairman of the Provincial People's Committee; Chairman of the People's Committee at the provincial and district levels decides to remove from the positions of Chairman of the People's Committee, Vice Chairman of the People's Committee at the direct subordinate level when the Chairman of the People's Committee, Vice Chairman of the People's Committee violates the law or does not properly perform the assigned duties and tasks.

3. The Chairman of the People's Committee and Vice Chairman of the People's Committee who are transferred or dismissed from their duties shall cease to perform their duties from the date the transfer or dismissal decision takes effect.

Thus, from March 2025, the Chairman of the People's Committee at the district level decides to remove the position of Chairman of the People's Committee of the commune as a direct subordinate when the Chairman of the People's Committee of the commune violates the law or does not properly perform his assigned duties and tasks.
