Reader stated that they have been working in the People's Public Security force since 2011, now over 10 years, with the rank of Captain.
Due to family circumstances and personal health, this person submitted a resignation application on January 2, 2024, which has been approved by their workplace leadership.
The reader asked: "Ministry of Public Security, could you please tell me which document stipulates the time limit for processing a resignation application? What is the maximum time limit for processing the application, and if the application is not processed within that time, do I have the right to resign on my own?"
Responding to this on July 30, the Ministry of Public Security stated that the procedures for officers and non-commissioned officers to cease service before the age limit (retirement, transfer, resignation) are stipulated in point a, clause 2, Article 7 of Circular No. 39/2023/TT-BCA dated August 15, 2023, by the Minister of Public Security, which specifies the age limit for service for officers, non-commissioned officers, and public security workers, as follows:
- The individual submits an application expressing their desire to cease service before the age limit (if transferring, an additional acceptance document from the receiving agency or unit outside the People's Public Security is required), to the directly managing unit.
- The directly managing unit receives the application from the officer, conducts discussions, and compiles a report for the immediate superior.
- The leadership of the superior unit (one or two levels higher, if applicable) organizes a meeting to vote on the officer's request to cease service before the age limit.
- After obtaining the voting results, the personnel organization agency submits the matter to the head of the unit for consideration and decision according to their authority or reports to the Ministry of Public Security leadership (through the Personnel Organization Department) for consideration and decision for officers and non-commissioned officers to cease service before the age limit (retirement, transfer, resignation).
Circular No. 39/2023/TT-BCA only stipulates the procedures for resolution, not the time limit for processing applications for officers and non-commissioned officers to cease service before the age limit. The resolution for officers and non-commissioned officers not holding leadership or command positions who request to cease service before the age limit falls under the authority of the unit head. Individuals need to contact the personnel organization agency of their current unit for guidance on resolution.
