Clause 1, Article 37 of Decree 54/2026/ND-CP (effective from February 9, 2026) amending and supplementing Article 68 of Decree 100/2024/ND-CP detailing a number of articles of the Housing Law on development and management of social housing (amended and supplemented in Decree No. 261/2025/ND-CP) stipulates the order and procedures for selling houses to the people's armed forces as follows:
a) After 30 days from the date of commencement, the investor of the project investing in housing construction for the people's armed forces is responsible for providing information related to the project (project name; project investor; project construction location; contact address; project implementation progress; project scale; number of apartments (including: total number of apartments of the project; apartment area; selling price (temporary) for each type of apartment; start and end time of receiving applications and other related contents) to the specialized housing agency of the Ministry of National Defense, Ministry of Public Security.
In case the information system and database on housing and the real estate market have been connected and exploited, publicize information about housing construction investment projects for the people's armed forces on this system in accordance with the law on construction and management of information systems and databases on housing and the real estate market;
b) Before the time of starting to receive applications for buying houses for the people's armed forces, the investor must send information on the time of starting to receive, ending to receive applications for purchase, number of apartments/houses for sale, apartment area, selling price of houses for the people's armed forces on the housing information system and real estate market and be sent to specialized housing agencies under the Ministry of National Defense, Ministry of Public Security.
The time to submit and receive dossiers is decided by the investor but is at least 30 days from the date of starting to receive dossiers;
c) The Ministry of National Defense and the Ministry of Public Security are responsible for assigning specialized housing agencies directly under or provincial-level units in the locality where the project is located to send project information to units under the people's armed forces in the area to notify subjects entitled to housing support policies for registered people's armed forces.
Individuals who need to register to buy houses for the people's armed forces submit applications to register to buy houses for the people's armed forces according to Form No. 03 in Appendix II of this Decree and documents proving the subjects and conditions for buying houses for the people's armed forces to the unit where the individual is working for synthesis and submission to specialized agencies directly under the Ministry of National Defense and the Ministry of Public Security;
d) Based on the registered number of units, the Ministry of National Defense and the Ministry of Public Security organize the allocation of apartments in the project to subordinate units stationed in the provincial level where the project is located according to the registration dossier ratio and the specific conditions of the armed forces. The allocation can be carried out in one or more phases, ensuring compliance with the number of apartments, registration dossiers and the actual implementation situation of the project.
Based on the number of apartments allocated, units directly under the Ministry of National Defense and the Ministry of Public Security organize the review and compilation of a List of subjects under management expected to buy houses for the people's armed forces, along with dossiers proving the subjects and conditions to enjoy social housing support policies according to regulations to send to specialized housing agencies directly under the Ministry of National Defense and the Ministry of Public Security.
People registering to buy houses for the people's armed forces must commit not to have received housing support policies, not to have bought houses for the people's armed forces and be responsible for ensuring the subjects and conditions to enjoy housing support policies for the people's armed forces at the time of signing the purchase and sale contract;
e) Specialized housing agencies under the Ministry of National Defense and the Ministry of Public Security are responsible for summarizing the List of expected housing purchases for the people's armed forces, which shows the personal information of the registrant and members of the household declared in the Application for Registration of Housing for the People's Armed Forces; send it to the Department of Construction of the locality where the project is located to check whether the person registering to buy housing for the people's armed forces has enjoyed or has not enjoyed housing support policies according to the provisions of the law on housing. The Department of Construction is responsible for responding in writing within 10 days from the date of receiving the List;
e) The specialized housing agency under the Ministry of National Defense and the Ministry of Public Security is responsible for reviewing, evaluating, summarizing the opinions of the Department of Construction and comparing them with the provisions of the law on housing to determine dossiers that meet the conditions to enjoy housing support policies for the people's armed forces, summarizing the List of eligible people to buy houses for the people's armed forces, submitting it to the leaders of the Ministry of National Defense and the Ministry of Public Security for approval of the List and notifying the project investor and subjects eligible to buy houses at the project.
For dossiers that do not meet the conditions, send them back and state the reason within 15 days from the date of Approval of the List.
In case people who need to buy houses for the people's armed forces meet the right subjects, meet the conditions according to regulations and have been approved in the List, but no longer need to buy houses, report to the unit where they are working to send to the Ministry of National Defense and the Ministry of Public Security to remove them from the List;
g) After the house meets the conditions to be sold according to the provisions of the law on real estate business, the investor shall sign a Housing Purchase and Sale Contract for the People's Armed Forces with customers; and at the same time update information about transactions, subjects who have purchased houses for the People's Armed Forces according to the provisions of housing law, law on construction and management of information systems, databases on housing and the real estate market.
The project investor is responsible for publicly announcing the List of customers who have signed house purchase and sale contracts for the people's armed forces (including members of households) at the investor's office, at the project implementation location and at the Real Estate Exchange (if any) or the investor's website on housing for the people's armed forces (if any) and sending it to the specialized housing agency under the Ministry of National Defense and the Ministry of Public Security for storage and service for management and inspection.
Thus, from February 9, 2026, the order and procedures for selling houses to the people's armed forces are regulated as above.
