Article 38 of Decree 55/2026/ND-CP (effective from February 9, 2026) amends and supplements Clause 12, Article 78 of Decree 100/2024/ND-CP detailing a number of articles of the Housing Law on development and management of social housing (amended and supplemented in Decree No. 261/2025/ND-CP) as follows:
“12. In case social housing is being leased according to the provisions of Clause 2, Article 26 of Decree No. 100/2015/ND-CP, the investor is prioritized to sell the house to the current tenant if the tenant has a need to buy it 10 years in advance and ensures the right subjects and conditions according to the provisions of this Decree or resells this house to the National Housing Fund.
The selling price of social housing currently on lease includes: the selling price that has been appraised, determined at the time of determination, appraised the rental price, plus the average annual loan interest of state-owned joint-stock commercial banks corresponding to the lease term and minus the depreciation value of the house. The depreciation value of the house is determined by the selling price of the house that has been appraised by a competent state agency multiplied by the lease term divided by the number of years of investment capital recovery calculated for lease.
Thus, from February 9, 2026, the selling price of social housing for rent includes the above factors.
