Sending a question to the Social Insurance agency, reader H.P said: "I have paid social insurance for 17 years (May 2008 - September 2025). In April 2024, I had an IVF but it was unsuccessful, in July 2024, I retired to enjoy social insurance benefits due to miscarriage.
June-April 2024; December-August 2024 and January-September 2025 I will still participate in social insurance.
In October 2025, I carried out embryo transfer and did not participate in social insurance due to sick leave to enjoy social insurance benefits.
In November 2025, I retired without pay and did not participate in social insurance.
In December 2025, I terminated my labor contract and enjoyed UI benefits, and expected to have children in June 2026.
I would like to ask, am I eligible to enjoy maternity benefits applied to female workers treating infertility? What documents do I need to submit and where to submit, when to submit?
Regarding this issue, Hanoi City Social Insurance answers as follows:
Because citizens have not provided information on social insurance codes, Hanoi Social Insurance has no basis to look up social insurance participation time on the data management software of the social insurance agency.
According to Clause 5, Article 50 of the 2024 Law on Social Insurance, conditions for enjoying maternity benefits for female workers giving birth are as follows:
Subjects specified in point b, clause 1 of this Article who have paid compulsory social insurance for 6 months or more in the 24 consecutive months before giving birth for cases of having to quit their jobs for infertility treatment.
Thus, citizens, based on the above regulations, compare with their own case to see if they are eligible for maternity benefits when giving birth for cases where they have to take leave from work for infertility treatment.
Dossier procedures specified in Clause 2, Appendix I, Decision No. 2222/QD-BHXH dated July 29, 2025 of Vietnam Social Security include: Request document Form 14-HSB, accompanied by a copy of the birth certificate or extract of the birth certificate or copy of the birth certificate of the child and Certificate of infertility treatment process of female workers, or discharge paper, or summary of medical record.
