Sending a question to Vietnam Social Insurance, reader C.V.L said: "I have a household registration in Hanoi, work in Ninh Binh, have paid social insurance since June 1997, in August 2016 the company closed my social insurance book. Since then, I have not paid any additional social insurance and have not received any benefits. So, can I withdraw one-time social insurance? If so, what are the procedures? ".
Regarding this issue, Vietnam Social Security responds as follows:
According to Clause 1, Article 1 of Resolution No. 93/2015/QH13 dated June 22, 2015 of the 13th National Assembly and Point b, Clause 1, Article 8 of the Government's Decree No. 115/2015/ND-CP of November 11, 2015, detailing a number of articles of the Law on Social Insurance in 2014 on compulsory social insurance, workers participating in compulsory social insurance after a year of work off but not paying social insurance for social insurance, but not to pay social insurance, they have to pay social insurance.
According to the letter Mr. C.V.L stated that the period of compulsory social insurance payment from June 1997 to July 2016 was 19 years and 2 months (if participating in continuous social insurance payment) and from August 2016 to present he has not continued to pay social insurance, if he has a request to receive one-time social insurance payment, he must submit the application to the social insurance agency where he resides for consideration and settlement according to regulations.
The one-time social insurance application as prescribed in Article 109 of the Social Insurance Law 2014 includes: Social Insurance Book; Application for one-time social insurance application (Form No. 14-HSB).
However, according to the provisions of the Social Insurance Law 2024, effective from July 1, 2025, the condition for the period of social insurance payment to receive pension is 15 years. Therefore, Mr. L should reserve to continue participating in social insurance or wait until retirement age instead of receiving one-time social insurance.
