On June 24, at the Provincial Citizen Reception Headquarters, Lao Cai Provincial Party Secretary Duong Quoc Huy chaired the regular citizen reception in June 2026.
At the reception, provincial leaders listened to the recommendations of Ms. Nguyen Thi Ly and Ms. Phung Thi Oanh regarding the proposal to issue a Certificate of Land Use Rights for the land area transferred from People's Group No. 3 (now Residential Group 2), Yen Binh commune.
According to the dossier, the land plot with an area of 1,593m2 previously belonged to the household of Ms. Nguyen Thi Yen. Before 2001, people in the group contributed 16 million VND to buy back the entire land area and works on the land, making it a community activity venue.
In 2001, because the residential group did not have legal status, Yen Bai Provincial People's Committee issued a certificate of land use rights to Yen Binh Town People's Committee for management and use for the purpose of building the hall of People's Group No. 3.
In the period 2004-2005, to have funds to build a cultural house, the residential group agreed to transfer a part of the land. A total of 368m2 was sold to two adjacent households, Ms. Nguyen Thi Ly and Ms. Phung Thi Oanh, each household 184m2, at a price of 30 million VND/household. The entire amount of 60 million VND was used to build common living facilities.
The transfer is carried out publicly, with the consensus of the residential community and the confirmation of the local government. After that, households build houses, use them stably and continuously, and no disputes arise.
However, when carrying out procedures for issuing Land Use Right Certificates, households discovered that the land area belonged to the land fund managed by the State, and at the same time the transfer was not under their authority because the residential group was not the legal entity allowed to transact land. This was identified as a "bottleneck" that caused the case to drag on for more than 20 years.
The process of handling continues to be complicated when land use planning changes. In 2021, the entire area was identified as urban residential land, but by 2023, Ms. Nguyen Thi Ly's land was converted to traffic land, while Ms. Phung Thi Oanh still belonged to residential land.
This change makes the handling direction for each case different, requiring consideration between planning, current status of use and people's rights.
Through review, specialized agencies determined that the case could not be resolved according to normal administrative procedures due to many historical, legal and planning factors.

The Provincial Party Committee's Internal Affairs Committee has chaired and coordinated with relevant units to survey, work with localities and agree to propose a handling plan in the direction of recovering and adjusting the area allocated to Yen Binh Town People's Committee, and at the same time complete the cadastral records to consider issuing certificates to households according to regulations.
Concluding the citizen reception, Lao Cai Provincial Party Secretary Duong Quoc Huy affirmed that the citizen's petition is legitimate and has a basis for consideration and resolution according to legal regulations.
The Provincial Party Secretary assigned the Yen Binh Commune Party Committee to direct the Commune People's Committee to preside over and coordinate with the Lao Cai Department of Agriculture and Environment, Lao Cai Department of Construction, Provincial Inspectorate and related units to urgently complete the dossier, build a roadmap to definitively handle the case, ensuring compliance with legal regulations and the legitimate rights of the people.
The completion deadline is set before August 15, 2026, and periodically report the progress to the Standing Committee of the Provincial Party Committee.
The Provincial Party Committee's Internal Affairs Commission is assigned to monitor, urge, and supervise the implementation; the Provincial People's Committee continues to direct the review of similar cases to remove backlogs in land management through periods.
