The Ministry of Finance has just announced a summary of opinions, reception, and explanation of comments from ministries, branches, and agencies on the draft Decree replacing Decree No. 92/2024/ND-CP dated July 18, 2024 of the Government on registration of cooperative groups, cooperatives, and cooperative unions.
Contributing opinions on the draft, the Ministry of Public Security proposed that in Article 2 (amendment of Article 5) on business registration agencies of cooperative groups, cooperatives, and cooperative unions, it is necessary to clearly explain the results of assessing the actual professional capacity of commune-level civil servants and information technology infrastructure in remote, isolated, border, and island areas, ensuring sufficient conditions to operate the National Information System on cooperative registration.
The Ministry of Public Security also requested to clarify the resource allocation plan, professional training plan and roadmap for handing over accounts and data from the district (old) level to the commune level so as not to interrupt or cause trouble for people's application submission.
Regarding this content, the Ministry of Finance said that through reviewing the implementation of household business registration and cooperative registration in the period from July 1, 2025 to now, the Ministry has found that commune-level officials and civil servants and information technology infrastructure in localities ensure to meet the requirements of business registration for cooperative entities on the Cooperative Registration Information System.
The Ministry of Finance has coordinated with Departments of Finance to participate in training, fostering, and professional development in cooperative registration for officials of commune-level business registration agencies.
At the same time, supporting commune-level business registration agency officials to convert data to the System according to regulations, ensuring that business registration issuance for cooperative groups and cooperative unions is smooth and effective.
According to the draft regulations, the business registration agency of cooperative groups, cooperatives, and cooperative unions is defined as follows:
In case a commune-level administrative unit establishes a professional department, the business registration agency of cooperative groups, cooperatives, and cooperative unions is a professional department under the commune-level People's Committee with the function and task of registering cooperative groups, cooperatives, and cooperative unions according to the decision of the People's Committees of provinces and cities directly under the Central Government.
In case a commune-level administrative unit does not establish a professional department, the business registration agency for cooperative groups, cooperatives, and cooperative unions is the commune-level People's Committee. The commune-level People's Committee arranges professional civil servants to advise and assist the commune-level People's Committee in performing the state management function of registering cooperative groups, cooperatives, and cooperative unions according to regulations.
The business registration agency of cooperative groups, cooperatives, and cooperative unions specified in the above clauses is called the commune-level business registration agency. The commune-level business registration agency has its own account and seal.
Explaining this regulation, the Ministry of Finance said that the re-definement of the authority to register cooperative groups and cooperatives is to be compatible with the two-level local government organization model and end the operation of district-level administrative units.
According to the Ministry of Finance, the commune-level business registration agency is a professional department with the function and task of registering cooperative groups, cooperatives, and cooperative unions (for commune-level administrative units that have established professional departments) or it is the commune-level People's Committee (for units that do not establish professional departments) as prescribed in Decree No. 150/2025/ND-CP and Decree No. 370/2025/ND-CP.
