Voters reflected that in Decision No. 1747/QD-TTg dated December 30, 2023, there are 10 national and provincial highways passing through Cu M'gar district.
These are: the North-South Expressway in the West CT.02 (opposite the West of Buon Ho town), Ho Chi Minh Road (National Highway 14); National Highway 9. Provincial routes: 688, 688B, 688C, 688D; 688E; 688F; 696; 697F. These routes do not specifically state the traffic planning boundary.
Regarding this content, the People's Committee of Cu M'gar district has made a recommendation in Official Dispatch No. 4292/UBND-TNMT dated October 11, 2024, but so far there has been no guidance document.
To ensure stable security and politics in the district, minimize petitions, complaints and reflections from citizens, voters requested the ministry to issue a document guiding the determination of the planning boundary.
Regarding the content of the voters' petition, the Ministry of Construction responded as follows:
The Prime Minister has approved the Dak Lak Provincial Planning for the period 2021-2030, with a vision to 2050 in Decision No. 1747/QD-TTg.
In particular, the road network development plan (highways, national highways, provincial roads) only determines the development direction, spatial organization, connection orientation, scale and investment roadmap.
The determination of land for road infrastructure is carried out in accordance with the provisions of the 2024 Road Law, Decree No. 165/2024/ND-CP dated December 26, 2024 of the Government and other relevant land laws and legal provisions.
According to Article 13 of the 2024 Road Law, the land for road infrastructure includes: road land including land for road construction and land for road protection and maintenance.
Land for construction of bus stations; parking lots; bus stops, parking lots; rest stops; auxiliary works serving road operations.
Road safety corridor.
The determination and management of road safety corridor boundary markers is stipulated in Articles 14 and 15 of the 2024 Road Law and guided in Articles 10 and 11 of Decree No. 165/2024/ND-CP of the Government.
According to the provisions of the Law on Urban and Rural Planning 2024, urban traffic routes are marked with red line boundaries according to the approved general planning or zoning plan.
Currently, for the 3 routes passing through Cu M'gar district managed by the Ministry of Construction, the project investors have set up road markers for road safety corridors and handed them over to local authorities for management.
That is the western bypass of Buon Ho town (North-South expressway, western CT.02) which has been marked with road markers according to the expressway planning. In which, the unit determined that the roadbed from the roadbed to each side was 17 m, handed over to the local government for management from March 2019.
The Ho Chi Minh Road (National Highway 14) section through Cu M'gar district under the Ho Chi Minh Road Upgrade and Expansion Investment Project, section km1738+148 - km1793+610 under the BOT contract form, has a scale of 2 lanes, roadbed width of 12 m, the standards of a level III plain road have been marked with a roadway boundary of the road safety corridor calculated from the road's soil to each side of the road of 13 m.
National Highway 29 through Cu M'gar district has a route from km193+600 to km220+500, a scale of a grade IV mountainous road, a 7.5m wide roadbed, and has been marked by Dak Lak with a roadway marking a road safety corridor from the road's land to each side of the road, 9 m, handed over to local authorities for management since 2017.
For the 7 provincial roads passing through Cu M'gar district, it is under the management of the Dak Lak Provincial People's Committee.
Therefore, it is recommended that the Dak Lak Provincial People's Committee, based on the approved Dak Lak Provincial Planning for the period 2021-2030, with a vision to 2050 and the above regulations, direct competent authorities and People's Committees at all levels to urgently review, determine and manage road safety corridor markers in accordance with legal regulations.
