On the Government Portal, Mr. P.T.D in Gia Lai asked that his company carries out the construction drawing design according to the three-step design process for a route.
However, when implementing, the company was only provided with a paper copy of the technical design documents and the technical design survey documents.
According to Mr. D's research, the Construction Law has related regulations on: Providing construction survey contractors with information and documents related to the survey; Requesting investors and related parties to provide relevant data and information according to the provisions of the contract to conduct construction surveys; providing full information and documents to construction design contractors; Requesting investors and related parties to provide information and documents for construction design work.
Clause 3, Article 88 of the Construction Law also stipulates that the establishment and storage of construction documents is carried out in accordance with the provisions of the law on archiving.
According to Article 32 of the Law on archives No. 33/2024/QH15, electronic archival documents include digital archival documents and other electronic archival documents.
However, the Construction Law does not specifically stipulate the form of documents that must be provided in the form of paper or digital data.
When Mr. D's company sent an official dispatch requesting the provision of documents in the form of digital data files (CAD, Word, Excel...), the investor responded that it could only provide paper documents.
Mr. D asked, is the investor's only provision of paper documents without providing digital data files in accordance with current legal regulations?
The Ministry of Construction responds to this issue as follows:
The law on construction does not have specific regulations requiring investors to provide survey and construction design documents in electronic form (such as *dwg, *doc, *xls, *pdf ...).
The provision of documents for construction design is stated and proposed to be based on the signed contract agreement on the provision of documents for implementation.
