Article 4 of Decree 185/2026/ND-CP stipulates that the dismissal of Village Heads and Residential Group Leaders shall be implemented in accordance with the provisions of the Law on Implementation of Democracy at the Grassroots Level 2022 and the Decree guiding the implementation of the Law on Implementation of Democracy at the Grassroots Level 2022.
The election and dismissal of Village Heads and Residential Group Leaders are carried out in accordance with the provisions of the Law on Implementation of Democracy at the Grassroots Level 2022 and the Decree guiding the implementation of the Law on Implementation of Democracy at the Grassroots Level 2022.
The term of office of the Village Head and Residential Group Leader is 05 years. In case it is necessary to ensure consistency with the time of reorganizing the village and residential group or due to force majeure situations such as natural disasters and epidemics that cannot organize elections on time, the Commune-level People's Committee decides to shorten or extend the term of office of the Village Head and Residential Group Leader but not more than 06 months. In case it is necessary to shorten or extend for more than 06 months, the Commune-level People's Committee shall report to the Provincial-level People's Committee for consideration and decision.
