Hanoi Chairman gives urgent instructions, Nam Son landfill residents are about to receive compensation

Hanoi reviews all old policies, compensation for people at Nam Son landfill

In August 2024, Lao Dong Newspaper published a series of articles: "Compensation for land with red books at Nam Son landfill at 0 VND", reflecting the shock of people in Nam Son commune, Soc Son district, Hanoi when receiving the compensation, support and resettlement plan prepared by the Soc Son District Land Fund Development Center.

Notably, thousands of square meters of residential land of people affected by Nam Son Waste Treatment Complex within a radius of 500m were compensated at 78,000 VND/m2, construction works on residential land were compensated 0 VND, 10% and 50%, recently (April 29, 2025), the Hanoi Department of Agriculture and Environment issued a document to remove difficulties.

According to the Report to the Hanoi People's Committee of the Hanoi Department of Agriculture and Environment, on April 24, 2025, the Department chaired a meeting with the Department of Construction and the People's Committee of Soc Son district to review recommendations related to compensation, support and resettlement policies for people within the project scope.

At a meeting with the Hanoi Department of Agriculture and Environment, the People's Committee of Soc Son district said that on August 9, 1999, the People's Committee of Hanoi issued Decision 3232 approving compensation and support policies to reclaim land and build the Soc Son Waste Treatment Complex.

Decision 3232 includes: For land in rural residential areas, households with houses within 100m adjacent to landfills that must be relocated and enjoy policies such as continuing to manage and use land for perennial crops or agricultural and forestry production; compensation for property damage on the land according to current regulations, no compensation for land damage;

Receive stable housing support of no more than 8 million VND/household; households that cannot arrange residential land themselves but have a need for resettlement land will be allocated residential land in resettlement areas according to the planning of Soc Son district, with a level of no more than 400m2/household and must pay land use fees according to the determination of the City Tax Department.

On November 26, 1999, the Hanoi People's Committee issued Decision No. 5047 approving the addition of compensation for damages when reclaiming land to build the Nam Son solid waste treatment complex.

Accordingly, communes with houses within the affected area from 101m to 500m of Nam Son solid waste treatment complex, if registered and committed to moving, will apply the same policy as communes within 100m.

According to the report of the People's Committee of Soc Son district, Nam Son commune, 54 households have received support money according to the above policy, but due to the division of households and transfer of land use rights, the number has increased to 113 households.

Of these, 109 households have had their plans approved, while 4 households have not yet approved. Notably, companies using residential land but have not been compensated for land have submitted petitions for compensation for land.

From this reality, the People's Committee of Soc Son district proposed that Hanoi City stop implementing Decision No. 3232 of the City People's Committee after 20 years from August 9, 2019 (expired for 20 years); at the same time, compensate, support and resettle people according to current regulations.

Requesting the People's Committee of Soc Son district to review and implement

In the Document reporting to the Hanoi People's Committee, the Hanoi Department of Agriculture and Environment requested the Soc Son District People's Committee to be responsible for reviewing and implementing the policies approved by the Hanoi People's Committee in Document No. 3489.

For the remaining cases (including the project to relocate to the environmentally affected area - radius of 500m), the City People's Committee approved other support policies on assets (houses, constructions built on land),

In which, support is equal to 80% of the compensation level for houses and constructions built before October 15, 1993, confirmed by the People's Committee at the commune level without documents to handle and prevent violations from competent authorities.

Support equal to 50% of the compensation level for houses and constructions built from October 15, 1993 to before July 1, 2004, confirmed by the People's Committee at the commune level without documents to handle and prevent violations from competent authorities.

Support equal to 10% of compensation for houses and construction works before July 1, 2014.

The total supported construction area is as follows: For works used for residential purposes: maximum 180m2 (average of the minimum residential land allocation limit and the maximum residential land allocation limit in this area).

For works used for other purposes: The maximum is the minimum area allowed to separate plots of land of corresponding types as prescribed in Article 14 of Decision 61/2024 dated September 27, 2024 of the Hanoi People's Committee.

"This support policy is similar to other support policies for companies when the State reclaims land to implement the Tam Trinh road construction project, Hoang Mai district.

The People's Committee of Soc Son district is responsible for determining the origin of land use, construction time, purpose of use of works, and subjects subject to policies according to regulations", the Hanoi Department of Agriculture and Environment stated.

Previously, on April 25, the Hanoi People's Committee issued Document 243 announcing the conclusion and direction of Chairman Tran Sy Thanh at the meeting to consider and resolve difficulties and problems when implementing site clearance by the environmental impact area migration project.

The Chairman of the City People's Committee concluded: Agreeing with the proposed policy of the Soc Son District People's Committee in Document No. 157 dated April 23, 2025.

Assign the Department of Agriculture and Environment to preside over and work with the Department of Construction and relevant units to specifically review the above proposals of the People's Committee of Soc Son district. There are documents guiding the People's Committee of Soc Son district to immediately deploy and implement the contents under its authority.

Requesting the Departments, branches and People's Committees of Soc Son district to faithfully implement the contents within their authority, implement decisiveness, responsibility, decisiveness and effectiveness;

Do not prolong the large-scale and urgent situation, ensure political security, social order and safety, favor socio-economic development, organize Party Congresses at all levels in the capital, apply solutions on the principle of: attaching responsibility to the Chairman of the People's Committee at district and commune levels; do not take advantage to violate the law or for profit.
