Borrow money to pay court fees
On December 31, speaking with Lao Dong, Ms. Nguyen Thi Nga (residing in Thang Binh district, Quang Nam province, name changed) - owner of the lottery ticket that won the special prize of 2 billion VND - said that she had paid an advance payment of 36 million VND in court fees.
Previously, Ms. Nga sued the Thua Thien Hue Lottery State Company Limited (Hue Lottery Company) at the People's Court of Huong Thuy Town (Hue) because the company refused to pay her the prize for the 2 billion VND jackpot ticket that had a torn corner.
Upon receiving the petition, Huong Thuy Town People's Court requested Ms. Nga to pay the advance civil court fees of 36 million VND and submit to the court the receipt of the advance civil court fees.
Within 7 days from the date of receipt of the notice, if Ms. Nga does not submit to the court the receipt of the advance payment of court fees without a valid reason, the court will return the petition to her according to the provisions of the Civil Procedure Code.
“I used my savings and borrowed money from relatives to pay the required court fees.
Including the amount of 12 million VND that Hue Lottery Company asked me to pay for the police to appraise the 2 winning lottery tickets (one secondary prize and one special prize), up to now, I have paid a total of 48 million VND, not to mention the cost of my son and I having to quit our jobs and go to Hue many times to resolve the case" - Ms. Nga shared.
Reluctantly sue
Lawyer Nguyen Van Ky, from Ky Nguyen and Associates Law Firm (Hue), who represents Ms. Nga in providing free legal support in this lawsuit, said that his client has also provided a certificate of the plaintiff's marital status, a document refusing to notify the Thua Thien - Hue Provincial Police of the results of the lottery ticket appraisal and requested the Huong Thuy Town People's Court to collect evidence documents such as the results of the lottery ticket appraisal.
Previously, the Criminal Techniques Department of Thua Thien Hue Provincial Police refused to notify Ms. Nga of the appraisal results upon request, on the grounds that she was not the subject requesting the appraisal. The appraisal agency is obliged not to notify Ms. Nga of the appraisal results, unless the subject requesting the appraisal (Hue Lottery Company) agrees in writing.
According to Ms. Nga, the lottery company's work was unclear, so she had to sue to claim her legitimate rights.
"If the company had told me from the beginning that the ticket was torn and not eligible for the prize, I would have happily accepted it, partly because I didn't preserve it well.
On the other hand, they asked for money to appraise the ticket, promised but did not return the appraisal results, and finally refused to pay the prize, causing us to go from hope, anxiety to indignation.
Lawyer Ky stated that the Huong Thuy Town People's Court's request for his client to pay an advance court fee was sufficient to accept the case. Regarding the advance court fee, the losing party will pay after the case is over.
