On the Ministry of Construction's Information Portal, reader T.H. H reflected: "I graduated from the University of Civil Engineering in 2013. In 2020, I was granted a private construction practice certificate of rank II (valid for 05 years until December 31, 2025 expires). I worked in a construction company from April 2020 to July 2023.
So, at this time (March 2026), if I register to take the exam to be re-issued a construction practice certificate of rank II, will I meet the conditions regarding the time of participating in construction activities?
After research, the Department of Economics - Construction Investment Management, Ministry of Construction has the following opinions:
According to the provisions of point b, clause 1, Article 75 of Decree No. 175/2024/ND-CP: "Re-issuance of practicing certificates includes cases where: practicing certificates that are still valid but lost or damaged or incorrectly recorded information or adjusted or supplemented personal information or fall into the cases specified in clause 4 of this Article".
Accordingly, the case of a citizen does not fall into the case of requesting a re-issuance of a construction practice certificate.
The case of citizens falling under the case where the certificate expires, is specified in point a, clause 1, Article 75 of Decree No. 175/2024/ND-CP.
The procedure for issuing practicing certificates for citizens is specified in Article 76 of Decree No. 175/2024/ND-CP.
Comparing according to the provisions of Article 76 on the procedure for issuing and revoking practicing certificates as follows:
1. Individuals submit 01 set of dossiers requesting a practicing certificate according to the provisions of Clauses 1, 2, 3, Article 88 of this Decree to the competent authority for issuing a practicing certificate in one of the forms specified in Clause 2, Article 7 of this Decree.
2. From the date of receiving sufficient valid dossiers as prescribed in Article 88 of this Decree, the competent authority issuing the practicing certificate is responsible for issuing the practicing certificate within the term of:
a) 10 days for cases of new issuance according to the provisions of points a, d, clause 1, Article 75 of this Decree from the date the test results meet the requirements;
b) 05 working days for cases of re-issuance as prescribed in point b, clause 1, Article 75 of this Decree;
c) 25 days for cases of conversion according to the provisions of point c, clause 1, Article 75 of this Decree.
3. The professional capacity of individuals in construction activities is evaluated according to the criteria of meeting general conditions and professional experience conditions according to the provisions of this Decree.
4. The competent authority issuing the practicing certificate decides on the issuance of the practicing certificate after having the evaluation results of the Council for considering the issuance of practicing certificates for dossiers requesting new issuance and conversion of practicing certificates. The time for notifying the evaluation results of dossiers requesting new practicing certificates is specified in Clause 3, Article 89 of this Decree.
5. In case the dossier is incomplete or invalid, the competent authority issuing the practicing certificate must notify the individual requesting the practicing certificate in writing once within 05 working days.
6. For cases of revocation of practicing certificates:
a) Within 10 days from the date of receiving the inspection and examination conclusion of the competent authority, which includes a recommendation to revoke the practicing certificate, or when detecting or having grounds to determine one of the cases of revocation of practicing certificates specified in Clause 2, Article 75 of this Decree, the competent authority to revoke practicing certificates shall issue a decision to revoke and declare the revocation of the practicing certificate; in case of non-revocation, it is necessary to have written opinions sent to the agency, organization, or individual with the revocation recommendation;
b) The competent authority to revoke the practicing certificate is responsible for sending the decision to revoke the practicing certificate to the revoked individual and posting it on its electronic information page; integrated on the electronic information page of the Ministry of Construction within 05 working days, from the date of issuance of the decision;
c) Individuals whose practicing certificates are revoked must return the original practicing certificate to the agency issuing the revocation decision within 05 working days from the date of receiving the revocation decision.
