Tax authorities speak out about the case of 3 times submitting additional tax finalization dossiers still facing obstacles

The tax authority in Bac Ninh has just received and responded to the case of 3 times submitting supplementary tax finalization dossiers but still not being approved.

On the Ministry of Finance Information Portal, readers reflected: On April 21, 2025, readers submitted personal income tax finalization dossiers for 2024. However, after 3 times of submitting supplementary dossiers, her procedures have not been resolved with some problems.

Readers said there was a discrepancy in information about dependents. She registered 2 dependents from 2022 and the full information of both dependents was displayed on the electronic tax account.

However, when carrying out tax refund dossiers, the tax authority notifies that the system only records 1 dependent person.

She has provided sufficient documents proving the 2 dependents but has not received a response related to the submitted documents.

In addition, she also reflected on the difference in deductions for dependents. In 2024, she changed 5 workplaces.

At some companies, she only worked for 1 month of probation and then quit, was not socially insured and was not entitled to deductions for these months.

She requested the tax authority to answer whether months that have not been calculated for deductions are calculated when tax finalization is carried out and what procedures need to be carried out to be resolved.

Through studying the reflected content, the Base Tax of 3 provinces of Bac Ninh has the following opinions:

Based on Clause 4, Article 25 of Circular No. 86/2024/TT-BTC dated December 23, 2024 of the Ministry of Finance stipulating tax registration:

Article 25.Place of submission and dossiers for changing tax registration information ...

4.For individuals specified in points k, l, n, clause 2, Article 4 of this Circular, when there is a change in tax registration information of themselves and dependents (including cases of changes in direct management tax authorities), submit dossiers to the income-paying agency or the Sub-Department of Taxation, the Sub-Department of Taxation in the area where the individual registers permanent or temporary residence (in case the individual does not work at the income-paying agency or does not authorize the income-paying agency) as follows:

a) Dossiers for changing tax registration information for cases submitted through income-paying agencies include: Delegation document form No. 41/UQ-ĐKT issued together with this Circular...

b) Dossier for changing tax registration information for cases submitted directly to the tax authority includes: Declaration form adjusting and supplementing tax registration information form No. 08-MST or form No. 20-DK-TCT...”.

Based on point a, clause 1, Article 9 of Circular No. 111/2013/TT-BTC dated August 15, 2013 of the Ministry of Finance stipulating family deductions:

Article 9. Family deductions

a) Family circumstance deduction is the amount deducted from taxable income before tax calculation for income from business, income from salaries and wages of taxpayers who are resident individuals...".

Based on the above regulations, the Base Tax of 3 provinces of Bac Ninh proposes:

Taxpayers shall carry out the registration of deduction for dependents through the income-paying agency or directly at the tax authority where they are permanently/temporarily residing, accompanied by a dossier proving dependents according to the guidance in Article 1 of Circular No. 79/2022/TT-BTC dated December 30, 2022 of the Ministry of Finance.

The family circumstance deduction is made on the entire taxable income before calculating personal income tax and is calculated for deductions for all months in the tax period when finalizing personal income tax.
