The Ministry of Construction drafted a circular on the functions, tasks and powers of specialized construction agencies under the People's Committees of provinces and centrally run cities and the People's Committees of communes and wards under provinces and centrally run cities. The draft takes effect from June 15, 2025.
According to the draft, the specialized construction agency at the commune level has an economic department for the commune, special zone or an economic, infrastructure and urban department for the ward and special zone of Phu Quoc.
One of the tasks of the Economic Department under the People's Committee of the commune is to advise and assist the People's Committee of the commune to grant, re -issue, renew, adjust and revoke the construction permit and inspect the construction of works under the licenses in the area in accordance with the law and the assignment and decentralization of the provincial People's Committee.
The Economic Department also has the following typical tasks and powers:
Submit to the People's Committee at the commune level:
Draft decision; medium-term and annual development planning and plans; programs and measures to organize the implementation of state administrative reform tasks in the construction sector and field; draft documents specifying the functions, tasks, powers and organizational structure of their units.
The draft document specifically stipulates the functions, tasks, powers and organizational structure of the Economic Department.
Draft programs and solutions for inter-sectoral mobilization and coordination in implementing the work of ensuring traffic order and safety in the area.
Investment projects for the construction of infrastructure in the area are implemented in accordance with the provisions of law and assigned and decentralized by the People's Committee at the commune level.
Draft decision to classify commune roads according to the provisions of law.
Submit to the Chairman of the People's Committee of the commune to draft documents under the authority of the Chairman of the People's Committee of the commune as assigned.
Advising and assisting the People's Committees at the commune level in organizing the implementation of tasks in the fields of: Construction planning; architecture; construction investment activities; urban development; technical infrastructure; housing; offices; construction materials in the area according to the provisions of law and assigning and decentralizing the Provincial People's Committee.
Organize the preparation, evaluation and submission to the People's Committee of the commune for approval, or organize the establishment for the commune -level People's Committee to submit to the competent authority to appraise and approve the construction planning in the area in accordance with the law.
Manage transportation activities in the area according to the provisions of law and instructions of competent state agencies.
Organize the implementation of measures to prevent, stop and handle violations of traffic works and encroachment on traffic safety corridors; coordinate with relevant agencies in clearing encroachments on traffic safety corridors in the area according to the instructions of specialized management agencies, the Department of Construction and the direction of the People's Committee at the commune level.
Coordinate with relevant agencies to deploy search and rescue activities by road, rail, inland waterway, maritime and aerial in the area.
Assist the People's Committees at the commune level in implementing and being responsible for the appraisal, registration, and issuance of licenses under their responsibility and authority.
Advise and assist the commune People's Committee for state management of collective economic organizations, private economy and guide operational guidance on collective economic organizations, private economy and operate guidance on non -governmental organizations operating in the fields of state management in the area in accordance with the law.
