Da Nang Inspectorate has just issued a Conclusion clearly pointing out a series of shortcomings of the 50m land use strip project along Nguyen Tat Thanh extended road (section from National Highway 1A to the end of the Golden Hills City project boundary), invested by Trung Nam Joint Stock Company, implemented since 2011, but has not been completely completed to date.
According to the inspection conclusion, after several planning adjustments, the project of the 50m strip of Nguyen Tat Thanh extended road - the area adjacent to the west of Nguyen Luong Bang road to Nam O bridge, with a total planned area of nearly 295,000 m2.
The project is implemented in the area of Hoa Lien commune, former Hoa Vang district and Hoa Hiep Nam ward, former Lien Chieu district, now Hoa Lien commune and Hai Van ward, Da Nang city.
According to the investor's report, the total investment of the project is more than 442.9 billion VND; of which the technical infrastructure is more than 296.3 billion VND, excluding the investment cost of social housing projects of more than 146.5 billion VND.
Da Nang City Inspectorate determined that the project did not carry out procedures for selecting investors, deciding to allow investment, but only issued an official dispatch from the Chairman of Da Nang City People's Committee in August 2011, assigning Trung Nam Joint Stock Company as the investor. This does not ensure the order and procedures according to regulations.
Notably, by the time of inspection, the project had not yet been approved for investment policy by competent authorities. The inspection determined that this was a prolonged shortcoming, affecting the progress of completing legal procedures, land, finance and project implementation.
Because the project does not have an investment permit decision or investment policy from a competent authority, there are no contents or criteria for project management and implementation such as project name, implementation time, progress, objectives, investment scale, total investment, land allocation method, investor selection, planned area, transfer of part of the project...


In the field of planning, the Department of Construction was determined to have advised on approving and adjusting the 1/500 detailed plan of the project in the 2011-2013 period inconsistent with the general plan approved by the Prime Minister in Decision 1465/QD-TTg dated June 17, 2002. In addition, the process of preparing and advising on the 1/500 detailed plan of the project did not consider determining and allocating land funds for social housing construction according to regulations.
Regarding land, the Inspectorate of Da Nang City clearly pointed out that the Department of Agriculture and Environment's advice on allocating land to Trung Nam Joint Stock Company for management, to invest in projects without going through land use right auctions or bidding to select investors, is not guaranteed by regulations. Land allocation is also carried out when the project has not yet had an investment permit decision or investment policy.
Another shortcoming is that the project has changed planning many times but has not re-determined financial obligations. The Inspectorate of Da Nang City said that this makes it difficult for functional agencies to have sufficient grounds to carry out the next procedures related to site agreement, detailed planning adjustment, and adjustment of land allocation and land lease decisions.
Although the investor reported that about 95% of technical infrastructure has been completed, the project is still facing obstacles in site clearance, resettlement, relocation of graves, land legality and issuance of land use right certificates. The prolongation from 2011 to now has made the project area unable to be completed synchronously, affecting people's lives and the urban embellishment process in the northwest of Da Nang.

Da Nang City Inspectorate assessed that the project basically meets the requirements of infrastructure connection, urban embellishment, expansion of urban development space and serving resettlement and people's needs in the area, however, the implementation process still has many shortcomings and prolonged obstacles that need to be handled so that the project can complete procedures and continue to be implemented.
Chief Inspector of Da Nang City proposed that the City People's Committee direct departments, branches, localities and Trung Nam Joint Stock Company to review and handle existing problems and obstacles of the project; organize self-criticism, rectification, and drawing experience for relevant collectives and individuals.
The inspection conclusion also proposed that relevant units base on specific mechanisms and policies to remove difficulties, complete legal procedures, land, financial obligations, and site clearance, thereby soon putting the project into operation, contributing to improving the quality of social infrastructure and people's lives in the area.
