On October 20, Lao Dong Newspaper published an article "Director of Department in Ha Nam is 130 times late in processing records", reflecting that since the beginning of 2024, Director of the Department of Justice of Ha Nam Bui Duc Thai has been 130 times late in processing records on the Public Service Portal.
The response letter to Lao Dong Newspaper dated October 22, signed by Mr. Bui Duc Thai - Director of the Ha Nam Department of Justice - said that in fact, all 130 files at the Ha Nam Department of Justice were handled in accordance with the provisions of the Law on Judicial Records (LLTP), the documents guiding the implementation and the correct administrative procedure (TTHC) settlement process issued with the Decisions announcing the list of TTHC of the Chairman of the Ha Nam Provincial People's Committee.
The Department of Justice also returns results to citizens, no records are returned late.
The Ha Nam Department of Justice said that the reason for the overdue records on the provincial Administrative Procedures Information System is that recently, the department has piloted the process of returning results of issuing electronic copies of Temporary Residence Cards to serve the implementation of the model of issuing Temporary Residence Cards on the national identification application VNeID.
To ensure the implementation of digitalization of administrative procedure settlement results in accordance with regulations, the results of the electronic LLTP Form are digitally signed directly by the leaders of the Department of Justice on the shared LLTP software of the Ministry of Justice and synchronized with the provincial administrative procedure settlement information system.
"However, due to the initial pilot period, the simultaneous return of results on both systems led to duplicate results in the account of the Director of the Department of Justice on the administrative procedure settlement information system of the province" - Director of the Department of Justice of Ha Nam explained in an official dispatch sent to Lao Dong Newspaper.
Immediately after discovering this technical error, the Ha Nam Department of Justice directly contacted the provincial Department of Information and Communications and VNPT Ha Nam to handle the synchronization of results and resolved the above situation.
Regarding the handling of 33 late payments from Mr. Ngo Duc Mau's account - Judicial Support Administration Department, when receiving the citizen's request for a Temporary Resident Card, the Ha Nam Department of Justice sent a dispatch to look up and verify temporary resident card information to the National Temporary Resident Card Center - Ministry of Justice.
According to the Ha Nam Department of Justice, the above 33 files are all files with complicated criminal records. The National Criminal Record Center - Ministry of Justice retained the verification of the citizens' criminal records and sent the verification results later than the prescribed deadline, leading to a delay in processing the application for Criminal Record Certificates by the Department of Justice.
The Ha Nam Department of Justice promptly sent a written apology to each citizen to extend the time to return results according to the provisions of Decree No. 61/2018/ND-CP dated April 23, 2018 of the Government on implementing the one-stop and one-stop mechanism in handling administrative procedures.
For the above-mentioned overdue cases, the Ha Nam Department of Justice has issued explanatory documents stating the reasons for each case. At the same time, it proposed that the Ministry of Justice separate the procedure for expunging criminal records into a separate administrative procedure to meet the practical implementation of the Law on Criminal Record.
