Decree No. 374/2025/ND-CP of the Government, effective from January 1, 2026, details a number of articles of the Employment Law on unemployment insurance (UI).
Article 20 states the content of transferring to another place to receive unemployment benefits:
Employees who have received at least 1 month of unemployment benefits according to regulations and have a need to transfer unemployment benefits to another province or centrally-run city must directly or through the National Public Service Portal submit a request to transfer unemployment benefits according to Form No. 19 issued together with this Decree and send it to the public employment service organization where they are receiving unemployment benefits.
Within 3 working days from the date of receiving the request from the employee, the public employment service organization is responsible for sending a notice on the transfer of the place to receive unemployment benefits to the provincial level social insurance to stop the payment of unemployment benefits according to Form No. 20 issued together with this Decree.
At the same time, send a letter of introduction according to Form No. 21 issued together with this Decree and a dossier to transfer the place of unemployment benefit to the public employment service organization where the employee transfers to.
- Dossier for transfer to receive unemployment benefits including:
Request to relocate workers to receive unemployment benefits;
Letter of recommendation for transfer to receive unemployment benefits;
Photocopy of the decision to receive unemployment benefits;
Photocopies of vocational training support decisions, decisions to temporarily suspend unemployment benefits, decisions to continue receiving unemployment benefits (if any);
Monthly job search notification photo (if any), other documents included in the unemployment benefit application.
Within 3 working days from the date of receiving the application for transfer to the place of unemployment benefits transferred by the employee, the public employment service organization shall send a written request to the provincial level social insurance to the place of transfer to continue paying unemployment benefits and issuing health insurance cards to the employee. The written request to the provincial level social insurance according to Form No. 22 issued together with this Decree.
In case the employee has received the application for transfer to receive unemployment benefits but has not submitted it to the public employment service organization where the transfer is from and no longer needs to transfer to receive unemployment benefits, the employee must return the letter of introduction for transfer to receive unemployment benefits to the public employment service organization where the transfer is from.
Within 3 working days from the date of receiving the letter of recommendation to transfer to a place receiving unemployment benefits, the public employment service organization shall send a written request to the provincial-level social insurance agency to continue paying unemployment benefits and issuing health insurance cards to employees.
