The certification sector alone generated 147,977 cases in 2 months (from July 1 to August 31), leading to the leaders of the People's Committees at the commune level taking a lot of time to process the records for the people.
There are times when it is not possible to resolve the issue in time according to regulations due to the need to carry out many other tasks at the same time.
In order to promptly meet the requirements of individuals and organizations in the field of certification, ensuring smoothness and speed, Khanh Hoa Provincial People's Committee proposed to issue a regulation that the Chairman of the Commune People's Committee is authorized to perform civil servants.
According to the draft Resolution submitted by the Khanh Hoa Provincial People's Committee to the Provincial People's Council for consideration and promulgation of a Decree stipulating the tasks and powers authorized in the field of certification by the Chairman of the Commune People's Committee for civil servants under the Commune People's Committee in 4 fields.
Certificate the original of documents and papers issued or certified by competent authorities in Vietnam; competent authorities and organizations of foreign countries; competent authorities and organizations of Vietnam affiliated with competent authorities and organizations of foreign countries.
Certificate the signature in documents and papers (applicable to both cases of certification of points and cases where the certificate authority cannot sign or cannot score points).
Certify the signature of the translator in documents and papers from foreign languages to Vietnamese, from Vietnamese to foreign languages.
Certify contracts and transactions related to assets such as real estate, land use rights, and housing; certify wills.
Certificate the documents refusing to receive the inheritance, authenticate the documents of the agreement on dividing the inheritance in which the inheritance is real estate, land use rights, and housing;
Certification of the declaration of inheritance in which the inheritance is real estate, land use rights, and housing.
Certify the amendment, supplementation, cancellation of contracts and transactions; correct errors in contracts and transactions; issue certified copies of the original of the contract and transaction that have been certified.
The Chairman of the People's Committee at the commune level will base on the practical situation in the locality to decide on the authorization. The authorization is carried out by separate administrative documents.
Authorized commune-level civil servants must have a university degree in Law or higher and have 2 years or more of experience working in the judicial field.
