Seeking opinions on supplementing the draft Law amending the Law on Energy Efficiency

The Ministry of Industry and Trade is soliciting comments from agencies, organizations and individuals on the Draft amending and supplementing a number of articles of the Law on Energy Efficiency and Savings.

According to the Department of Energy Saving and Sustainable Development (Ministry of Industry and Trade), the Draft Law amending and supplementing a number of articles of the Law on Energy Efficiency and Savings will be submitted to the Government in February 2025, with a deadline for submission to the National Assembly Standing Committee in March 2025.

Considering the provisions of the Law on Promulgation of Legal Documents (amended) expected to take effect from April 1, 2025, in order to meet the requirements for submission to the National Assembly for comments and approval at the 9th Session (May 2025), the Ministry of Industry and Trade requests that agencies study and give opinions on the draft documents of the Law on Amending and Supplementing a Number of Articles of the Law on the Law on the Use of Energy Savings and Efficiency, including: Draft Law; Draft Government Submission; Report on reviewing Party policies and guidelines, legal documents, international treaties related to the Draft; Report on summarizing law enforcement; Report on evaluating administrative procedures, decentralization, ensuring gender equality, and ethnic policies.

The written comments should be sent to the Ministry of Industry and Trade, and a soft copy should be sent via email: VietTV@moit.gov.vn before February 21, 2025 for the Ministry of Industry and Trade to synthesize and carry out the following procedures.

It is known that the Ministry of Industry and Trade is drafting a Law amending and supplementing a number of articles of the Law on Energy Efficiency to strengthen incentive mechanisms and promote energy-saving and efficient use.

According to the Ministry of Industry and Trade, the Law on Energy Efficiency and Sauciety Use (Law No. 50/2010/QH12) was passed by the 12th National Assembly, 7th session on June 17, 2010, effective from January 1, 2011. The law has created a legal corridor, removed barriers, concretized regulations on management measures, techniques and policies to promote energy-saving and efficient use in all activities of industrial production, agriculture, transportation, civil construction, lighting and community activities, creating conditions for synchronous implementation of energy-saving and sustainable use activities of the country.

However, after 15 years of implementation, the Law has revealed its shortcomings. It is necessary to review and amend a number of contents stipulated in the Law on Energy Efficiency and Savings and related laws to promptly adjust social relations arising in the practical use of energy in the manufacturing and processing of industrial products to respond to new challenges.

In addition, mobilizing resources for green, sustainable industrial transformation, economical and efficient use of energy and resources in Vietnam is still lacking and weak, not meeting market requirements.

Vietnam has committed to bringing net emissions to "0" by 2050. Therefore, along with the drastic conversion of basic and reasonable energy sources towards minimizing fossil energy sources and increasing renewable energy sources, Vietnam needs to consider amending the Law on the Use of Energy economy and Efficiency in the direction of strengthening mandatory regulations and sanctions instead of encouraging the implementation of energy-saving solutions...

Therefore, the development of a Law amending and supplementing a number of articles of the Law on Energy Efficiency and Savings is extremely necessary to continue to thoroughly grasp and institutionalize the viewpoints and policies of the Party and State to solve problems raised by domestic practice, in accordance with international laws and practices, while enhancing the effectiveness and efficiency of state management, eliminating obstacles and barriers, creating a favorable legal corridor, strengthening incentive mechanisms, promoting the use of energy for savings and efficiency.

Create conditions for the community to participate in energy-saving and efficient use in all fields

According to the Ministry of Industry and Trade, the purpose of promulgating the Law is to amend and supplement a number of articles of the Law on Energy Saving and Efficient Use to improve the practicality and feasibility of the Law on Energy Saving and Efficient Use, ensuring the consistency and unity of the legal system in energy use activities, in accordance with international commitments.

At the same time, strengthen incentives and create conditions for communities, households, organizations and individuals to participate in energy-saving and efficient use activities in all areas of the country's socio-economic life for the goal of sustainable national development.

Complete regulations on energy-saving and efficient use management for industrial production facilities, construction works and key transport facilities. Prioritize investment in developing industries with high energy efficiency, energy saving to serve the goal of rational use of energy sources, environmental protection and sustainable development.

Strengthen incentive mechanisms, financial support tools on taxes, land, interest, and loan guarantees for businesses investing in projects on energy-saving and efficient use; increase incentives for the development of consulting services (a network of energy-saving consulting centers, energy service companies) to promote energy-saving and efficient use in production, business and daily life of the people.

Expanding and improving the effectiveness of international cooperation, fully implementing international commitments in the field of energy conservation and use in a cost-effective and efficient manner. Increase foreign and private investment attraction in the field of energy-saving and efficient use.
