According to Vietnam Social Insurance, compared to the Law on Social Insurance (VSS) 2014), the new law has many important amendments and supplements, notably the regulations directly related to the rights and responsibilities of employers.
Supplementing the rights of employers
The 2024 Social Insurance Law has legalized a number of rights of employers that are currently stipulated in sub-law documents. According to Article 12, employers are allowed to:
Temporarily suspend compulsory social insurance payment according to the provisions of law in certain cases;
Be guided by the Social Insurance agency on the procedures for implementing social insurance regimes;
access to information and documents to propagate and disseminate policies and laws on social insurance to raise awareness and comply with regulations.
The legalization of these rights contributes to ensuring transparency, creating more favorable conditions for businesses in the process of implementing social insurance policies.
Supplementing the responsibilities of employers
In addition to expanded benefits, the 2024 Social Insurance Law also stipulates more clearly the responsibilities of employers, in order to protect the legitimate rights of employees.
According to Article 13, employers are responsible for:
Compensation for employees according to the provisions of law if they do not perform or do not fully fulfill their responsibility to pay compulsory social insurance according to the provisions of this Law, causing damage to the legitimate rights and interests of employees;
Coordinate and create conditions for the social insurance agency to recover the social insurance amount that is not in accordance with the regulations of the employee when there is a decision by the competent authority.
These new regulations clearly demonstrate the spirit of the rule of law, while enhancing the responsibility of employers in ensuring social insurance benefits for employees.
