The draft Law amending and supplementing a number of articles of the Law on Social Insurance (BHXH) is being consulted with many new proposals to improve social security policies and overcome obstacles arising in the process of implementing the 2024 Law on Social Insurance.
Contributing opinions to the draft, the Department of Home Affairs of Hung Yen province proposed to improve regulations on retirement regimes for some specific groups such as preschool teachers.
Hung Yen Department of Home Affairs also contributed opinions to review and amend regulations related to social pension allowances and monthly survivor's allowances to ensure synchronicity; and at the same time complete regulations on handling cases where one-time social insurance benefits have been enjoyed but subsequently social insurance arrears arise.
The agency in charge of drafting the amended Law on Social Insurance, the Ministry of Home Affairs, said that it has absorbed the content of reviewing and completing regulations related to social pension and monthly survivor's allowance.
The Department of Home Affairs of Bac Ninh province proposed to study and supplement regulations on temporarily suspending the enjoyment of monthly pensions and social insurance allowances for people enjoying monthly social insurance benefits in cash in cases where the social insurance agency cannot verify the information of the beneficiary and the beneficiary does not come to receive the benefits for more than 6 months.
When the beneficiary has a written request and is verified to be eligible for benefits, they can continue to enjoy social insurance benefits according to regulations.
Regarding this suggestion, the Ministry of Home Affairs said that it does not accept it and requested the social insurance agency to base on interconnected data and the national population database for verification.
The Department of Home Affairs of Cao Bang province proposed to study and adjust the formula for calculating the percentage of pension benefits in the direction of ensuring fairness and suitability for beneficiaries in order to limit the situation of enjoying one-time social insurance benefits, creating motivation for employees to participate in long-term and stable social insurance, while ensuring equality between men and women, and between groups of subjects.
The Department of Home Affairs of Cao Bang province proposed to stipulate the benefit rate according to the participation time milestones (from 10 years to under 15 years, from 15 years to under 20 years, from 20 years to under 30 years, from 30 years or more...), according to the principle that the longer the contribution period, the higher the accumulated rate added.
However, the Ministry of Home Affairs said that it does not accept this content because changing the benefit calculation rate will have a major impact on workers, and needs to be carefully studied and evaluated.
According to social insurance data, in 2025, the social insurance agency has settled for more than 175.7 thousand people to receive pensions, an increase of 93% compared to 2024. The main reason is the arising number of people to be settled for pension benefits according to Decree No. 177/2024/ND-CP and Decree No. 178/2024/ND-CP (amended and supplemented in Decree No. 67/2025/ND-CP).
As of the end of the first quarter of 2026, the number of people receiving monthly pensions and social insurance allowances is more than 3.5 million people, an increase of 3.01% compared to 2024. It is expected that by the end of 2026, the number of beneficiaries will reach more than 3.54 million people.
