Fined business says it bought land from people
In 2024, Dong Giang Agricultural Company Limited (Tu commune, Dong Giang district) was fined 80 million VND by the People's Committee of Quang Nam province for occupying agricultural land which is production forest land in rural areas.
This enterprise has used 6,119.1 square meters on the field without completing the procedures for land allocation and lease according to the provisions of law to build and put into use environmental works including: 2 biogas tanks, 2 regulating lakes, 2 biological lakes, 1 centralized wastewater treatment system and 1 level 4 house to store chemicals.

According to the leader of Dong Giang Agricultural Company Limited, the company invested in a clean pork farm since 2018.
However, due to the small area rented for the project, the company bought additional land from households to build environmental works to serve the project.
"Our company thinks that this is land that people sold to the company, so we can buy it. The company does not think that buying land from people to build environmental projects, but not completing land lease procedures is a violation of the law" - the company leader said, after paying the fine, the company proceeded to register land lease procedures according to regulations.
According to statistics, in 2024, there were nearly ten cases of encroachment on agricultural land in Quang Nam that were discovered and punished by authorities.
There was a case of 13 households together occupying more than 2.3 hectares of production forest land in the Weasel Forest area, managed by the People's Committee of Tam Loc commune, Phu Ninh district.
The local authorities determined that in the violating area, households planted acacia trees from 2012 to 2024, so they drew up a record and proposed that the competent authority fine each violator 105 million VND, with a total fine of more than 1.36 billion VND.
Resolving confusion in land records
Recently, at a thematic conference on the handling of agricultural land used for public purposes (public land) and land with the purpose of use recorded as "residential land", letter T (residential land), the Standing Committee of Quang Nam Provincial Party Committee assessed that, in addition to positive aspects, in the process of implementing land management and use, there are still many difficulties, long-term problems and inadequacies compared to the provisions of law.
This is a major bottleneck and "bottleneck" in land management, compensation, site clearance, support and resettlement when the State reclaims land to implement key projects and works, driving forces of the province.

The Thaco - Chu Lai Industrial Park project in Tam Anh Nam commune (Nui Thanh district) with a land clearance scale of 451 hectares is an example of the consequences of a history of inconsistent land management and use.
The province has extended the land clearance many times since the end of 2019, but the project's cleared land has not been completed yet. The specific problems listed in this project are public land; land consolidation and plot exchange; building houses on agricultural land; households not agreeing on compensation for production forest land, requesting compensation for perennial land...
From that reality, Quang Nam determined that first of all, it must completely resolve the ambiguous situation in the "records" of public land management.
