The Government has recently issued Decree No. 83/2024/NĐ-CP amending and supplementing Clause c, Article 6 of Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government on the establishment, reorganization, and dissolution of public non-business units.
According to this, for public non-business units that are self-financed for part of their regular expenditures, public non-business units that are funded by the state budget for their regular expenditures, the average number of deputy heads for units within the organizational structure of a ministry or a ministerial-level agency shall not exceed 3 people per unit.
Public non-business units under a ministry (excluding public non-business units under the Ministry of Public Security and the Ministry of National Defense, excluding units within the organizational structure of a ministry or a ministerial-level agency), public non-business units under a government agency (including public non-business units abroad) and public non-business units under a provincial people's committee with 20 or fewer employees shall be allocated no more than 2 deputy heads; those with more than 20 employees shall be allocated no more than 3 deputy heads.
Decree also stipulates that no more than 2 deputy heads shall be allocated for each of the following units:
+ Public non-business units under a general department and an organization equivalent to a general department under a ministry (hereinafter referred to as a general department under a ministry);
+ Public non-business units under a department, under a sub-department under a department under a ministry;
+ Public non-business units under the Office under a ministry;
+ Public non-business units under a department under a general department under a ministry;
+ Public non-business units under an organization established by the Government or the Prime Minister that is not a public non-business unit;
+ Public non-business units under a specialized agency under a provincial people's committee (hereinafter referred to as a department);
+ Public non-business units under a sub-department and equivalent under a department;
+ Public non-business units under other administrative organizations under a provincial people's committee.
+ Public non-business units under a district, ward, town, city under a province, city under a centrally-run city (hereinafter referred to as a district).
For Class I hospitals and above, public health units performing provincial-level disease control and prevention tasks; schools with multiple levels of education with a scale of 40 classes or more, shall be allocated no more than 3 deputy heads.
Decree No. 83/2024/NĐ-CP takes effect on September 1, 2024.
