According to the instructions, the above agency has many advisory powers on land and minerals.
Advising on land use rights
Regarding land, this is an agency to advise and assist the People's Committees at the commune level in giving opinions on provincial-level land use planning; organizing the preparation and adjustment of commune-level land use planning, 5-year commune-level land use plan; organizing the implementation of local planning and land use plan; managing recovered land in rural areas; directing and organizing the implementation of 6 tasks of compensation, support, and resettlement; publicly announce commune-level land use planning, 5-year commune-level land use plan and other tasks under the authority of the People's Committee at the commune level.
Advising and assisting the Chairman of the People's Committee at the commune level in deciding on land recovery, deciding on compensation and resettlement support plans, deciding on specific land prices, deciding on resettlement housing prices, deciding on land allocation and lease, allowing the change of land use purposes for individuals, deciding on land allocation to the community according to regulations under his authority; deciding on land allocation, extending land allocation according to regulations and other tasks under the authority of the Chairman of the People's Committee at the commune level.
Appraise records on land allocation, land lease, land recovery, land use purpose conversion; check records for granting certificates of land use rights and ownership of assets attached to land for the first time and advise the People's Committees at the commune level to issue certificates of land use rights and ownership of assets attached to land to subjects under the authority of the People's Committee at the commune level;
Preside over the organization of determining specific land prices as a basis for calculating land use fees, land rents, calculating compensation when the State reclaims land and other cases according to the provisions of law; organize the appraisal of compensation, support and resettlement plans according to the provisions of law;
Preside over and coordinate the implementation of state management tasks on land according to regulations.
Determining fees for mineral exploitation rights
Regarding geology and minerals: Advising and assisting the Chairman of the People's Committee at the commune level in granting certificates of mineral recovery registration according to regulations; organizing the determination, submitting to the Chairman of the People's Committee at the commune level for approval, adjustment, re-approval, and settlement of fees for granting mineral exploitation rights in cases of mineral recovery registration under the authority of the Chairman of the People's Committee at the commune level;
Implement measures to protect mineral and environmental resources in mineral activities according to the provisions of law; ensure social order and safety in areas with minerals;
Organize the mobilization of local people not to illegally exploit, purchase, store, or transport minerals; detect and denounce illegal mineral exploitation;
Contributing opinions on the Management Plan for geology, minerals, mineral exploration projects, mineral exploitation investment projects, environmental impact assessment reports and environmental licenses of mineral exploitation projects, and mine closure projects in the area;
Participating in the Council for appraisal of the results of determining the cost of refunding and assessing mineral potential, the cost of mineral exploration to be refunded by the state has invested in implementation in the area; coordinating with the Department to hand over the land markers, area of mineral activities according to the license and decide to lease land to organizations and individuals licensed to operate minerals in the area; inspect and accept environmental improvement and restoration;
Develop a plan and proactively arrange resources to implement mineral protection activities under the authority of the locality; carry out clearance and prevent illegal mineral exploitation activities when detecting or receiving reports in the area.
