According to Article 5 of Decree 151/2025/ND-CP, the Chairman of the District People's Committee is assigned the authority to the Chairman of the Commune People's Committee as follows:
(1) The authority of the People's Committee at the district level according to the Land Law is transferred to the Chairman of the People's Committee at the commune level, including:
- Approving the agricultural land use plan of an economic organization; approving the rice land use plan of an individual.
- Decision to reclaim land according to Clause 2, Article 83, Point b, Clause 3, Clause 5, Point b, Clause 6, Article 87 and Clause 7, Article 91 of the Land Law; issue a Notice of Land Relaim.
- Approving compensation, support and resettlement plans; land recovery enforcement plans and enforcement costs.
- Decision on resettlement housing sale price in the area.
- Issuing a Certificate of land use rights, ownership of assets attached to land; re-determining the residential land area and issuing a Certificate.
- Record land prices in land allocation and lease decisions, permission to change land use purposes, extend land use, adjust land use term, change land use forms in cases where prices are applied in the land price list or specific land prices are determined.
- Decision to establish a specific Land Valuation Council.
- Decision on land allocation, lease, permission to change land use purpose for individuals, communities, agricultural land allocation according to the provisions of Articles 123 and 178 of the Land Law.
- Approving the plan to contribute land use rights, adjust land to implement projects to renovate and develop rural residential areas, expand and upgrade rural roads (according to Article 219 of the Land Law).
(2) The authority of the Chairman of the District People's Committee under the Land Law is transferred to the Chairman of the Commune People's Committee, including:
- Establish a Compensation, Support and Resettlement Council (Article 86); issue a decision on compulsory counting (Article 87); enforce counting (Article 88); enforce land recovery and establish an Enforcement Board (Article 89).
- Decision on land use and extension of land use; establish a Council and decide on the compensation level for damages caused by land use (Article 90).
- Decision on specific land prices (Article 160).
- Resolving land disputes between households, individuals, and communities (Article 236).
(3) The authority to hire a consulting organization to determine land prices to determine specific land prices (according to Clause 3, Article 160 of the Land Law) is transferred to the People's Committees at the commune level.
(4) The authority of the District People's Committee according to the decrees guiding the implementation of the Land Law is transferred to the Chairman of the Commune People's Committee, including:
- Establish a Specific Land Valuation Council (Decree 71/2024/ND-CP);
- Approving compensation, support and resettlement plans (Decree 88/2024/ND-CP);
- Decision on compensation land price in the form of land for other purposes (Decree 88);
- Land allocation to eligible individuals (Article 53, Decree 102/2024/ND-CP);
- Approving the land use rights auction plan (Article 55);
- Approving the plan for using agricultural land and combined land (Articles 78, 99);
- Approving the land use rights contribution plan (Article 100);
- Approving the plan to enforce the implementation of the decision to resolve land disputes (Article 108).
(5) The authority of the Chairman of the District People's Committee in the decrees is also transferred to the Chairman of the Commune People's Committee, including:
- Organize the implementation of specific land price decisions (Article 38, Decree 71);
- Determining the compensation level caused by land use (Article 29, Decree 102);
- Establish a compulsory counting enforcement board (Article 36;
- Issuing a decision to enforce the implementation of the decision to resolve land disputes, establishing and deciding on the composition of the Enforcement Committee (Article 108).
