On September 13, information from the Ministry of Justice said that Deputy Minister Phan Chi Hieu had a working session with the Department of Judicial Assistance on a number of key tasks of the unit.
Regarding the work of appointing and granting practice certificates in the field of judicial supervision, the Department has received, reviewed, and advised the Ministry's leaders to resolve the following documents: granting, re-granting, and revoking lawyers' practice certificates for 1,111 cases; reappointing notaries for 135 cases; granting establishment licenses for 1 Trade Rehabilitation Center; granting and re-granting Certificates of Benental practice for 135 cases.
At the meeting, leaders of the Department and the Departments under the Department discussed specific contents on institutional construction, documents, projects, and improvement of laws on judicial support; amending and supplementing regulations on the functions and tasks of the Judicial Support Department in the context of the Department Inspectorate terminating its operations;
Complete the Decree amending and supplementing a number of articles of Decree No. 23/2015/ND-CP of the Government on granting copies from the original book, certifying copies from the original, certifying signatures and certifying contracts and transactions; provide professional guidance in the field of notarization and certification for localities in the context of operating local authorities at 2 levels.
At the meeting, Deputy Minister Phan Chi Hieu requested the Department of Judicial Assistance to continue to proactively implement assigned tasks, ensuring progress and quality.
At the same time, the Deputy Minister noted that in the legal field, continue to closely follow the consolidation of documents related to lawyers. For the Public Lawyer project, it is necessary to closely follow the Government's instructions, on the basis of timely comments.
In the field of notarization and certification, it is necessary to accelerate the construction of a Notary Database according to the requirements of the 2024 Notary Law; proactively review legal regulations to specifically identify transactions that need notarization and certification; continue to proactively and effectively implement electronic notarization; focus on developing notary offices to ensure social needs; continue to transfer public tasks to notary offices.
Previously, in April, Lao Dong Newspaper published an article reflecting "There are documents that are no longer required to be notarized" and the article "It is urgent to reduce and eliminate unnecessary notarization".
Accordingly, although there has been an improvement, the practice of certification and notarization shows that the requirement for certification and notarization with many types of documents is no longer necessary. In the context of many shortcomings in certification and notarization activities, the authorities also pointed out a series of violations of this activity in recent times.
