Regarding violations in the field of land in the Dong Ho lagoon area (Ha Tien city, Kien Giang province), the leaders of the city People's Committee have sent a written response to the incident to the Propaganda Department of the Kien Giang Provincial Party Committee.
According to the People's Committee of Ha Tien City, on November 21, 2023, the Chairman of the People's Committee of Kien Giang province issued Decision No. 2877 on the establishment of the Working Group to conduct a legal review of land in the Dong Ho lagoon area in To Chau ward and the Phu My Species - Habitat Conservation area in Phu My commune, Giang Thanh district (referred to as Working Group 2877 of the Provincial People's Committee).
Carrying out the assigned tasks, on April 12, 2024, the Working Group organized a field survey and worked with the People's Committee of Ha Tien City to determine the situation and developments of land encroachment and occupation in the Dong Ho Lagoon Area. On April 17, 2024, the Department of Natural Resources and Environment proposed and recommended the Chairman of the Provincial People's Committee to issue a directive document. Assigning the People's Committee of Ha Tien City to urgently handle, promptly prevent, immediately and thoroughly remedy the new violations that have occurred and are occurring (the land with water surface outside the boundary has been inspected and the inspection conclusion of the Provincial People's Committee before).
The People's Committee of Ha Tien City urgently issued a plan to handle the situation of land encroachment and occupation and the management and use of land in the Dong Ho lagoon area; in which, it is important to handle some main contents such as: considering granting land use right certificates to people for land areas eligible for certificates according to the provisions of current land law, and at the same time specifically identifying the land areas that are not eligible for certificates, and the land areas with violations (encroachment and occupation). Publicly announce the results of the review to the people and publicize these results to the relevant agencies and authorities to gain consensus and consistency in handling the next steps.
Determine the boundaries and landmarks for areas with new violations compared to the scope of Inspection Conclusion No. 17 dated November 27, 2006 of the Provincial People's Committee to serve as a legal basis for handling administrative violations, enforcing land return, and remedying the consequences of violations.
Determine the legal and specific boundaries of the residential area of Residential Area 5, Dong Ho Ward; to prevent and promptly handle the encroachment and occupation of State-managed land for the plots of land behind this residential area. At the same time, pay attention to early implementation of zoning planning, detailed planning of Dong Ho lagoon area in general and update and adjust the planning, land use plan according to the general planning of Ha Tien city approved by the Government, as well as the general direction of the Provincial People's Committee. This is the basis for management and arrangement of land use after recovering illegal land, associated with considering people's livelihoods.
Based on the conclusion of the Director of the Department of Natural Resources and Environment - Head of Working Group 2877 - Ha Tien City People's Committee issued Plan No. 115 dated May 29, 2024 on the implementation of inspection and handling of violations of land laws in the Dong Ho Lagoon area, Dong Ho ward (referred to as Plan No. 115). On June 13, 2024, the City People's Committee issued Decision No. 1201 on the establishment of a Working Group for measurement, inspection and handling of violations of land laws in the Dong Ho Lagoon area (referred to as the Measuring Working Group).
The city's surveying task force has detected and transferred the files to the Chairman of the Provincial People's Committee to issue a Decision on administrative sanctions according to its authority for 3 cases with an area of 24 hectares. The city's surveying task force is continuing to perform its tasks according to Plan No. 115, synthesizing and advising the City People's Committee to report the implementation results to Task Force 2877 of the Provincial People's Committee and the Provincial People's Committee.
The leader of the Ha Tien City People's Committee also informed that currently, the Working Group 2877 of the Provincial People's Committee is continuing to coordinate with the Ha Tien City People's Committee to implement the handling of violations in the Dong Ho Lagoon area according to the assigned tasks. After completion, Working Group 2877 will report the implementation results and recommend the Chairman of the Provincial People's Committee to consider handling the responsibilities of related officials (if any) according to regulations.
Dong Ho Lagoon has a natural area of over 1,384 hectares, of which the water surface area is over 900 hectares. It is a wetland resource of Kien Giang with socio-economic exploitation value, meeting the living needs of people in Ha Tien and neighboring areas. In recent years, Dong Ho Lagoon has been encroached upon by some people, from a few dozen households living in the lagoon, now there are up to several hundred households living in the lagoon.
