Update information on Tien Tan gas station license
Recently, Lao Dong Newspaper published an article about the situation of dyke encroachment in Dan Phuong, Hanoi, reflecting the risk of Tien Tan gas station (Tien Tan intersection, Dan Phuong district, Hanoi) violating the protection of the dyke.
Previously, on October 21, the Deputy Head of the Economic Department of Dan Phuong district said that Tien Tan gas station's license had been revoked.
After the article was published, on November 12, Mr. Nguyen Viet Dat - Head of the Economic Department of Dan Phuong district - updated the information as follows: Tien Tan gas station had its license revoked due to fire prevention and fighting work, however, it has now been granted a license to operate again.
According to the documents provided by the unit, on April 6, 2021, Tien Tan gas station was suspended under Decision No. 50/QDDC-CADP. After that, this gas station was restored to operation by the Chief of Dan Phuong District Police from April 26, 2022. On September 6, 2024, the Hanoi Department of Industry and Trade issued a certificate of eligibility for the store to retail gasoline.
Will clarify the scope of dike protection
To clarify the issue of Tien Tan gas station being at risk of encroaching on the dike, the reporter asked the authorities of Dan Phuong district to clarify the scope of dike protection.
Mr. Nguyen Viet Dat - Head of the Economic Department of Dan Phuong District - said that the Hanoi Department of Agriculture and Rural Development is currently coordinating with the district to determine the boundary of the dike safety corridor. After that, the unit will determine whether the gas station is within the dike protection area or not.
Mr. Dat added that after receiving public feedback, he personally inspected the Tien Tan gas station. However, determining the dike protection corridor will require more time because the dike construction area is long. Mr. Dat said that in the past, the dike was quite small. Determining the protection corridor as well as determining whether the construction of the gas station violated the law or not will require verifying historical factors.
According to documents provided by the unit to Lao Dong Newspaper, on July 2, 1999, Mr. Nguyen Dang Tat submitted a request to the Dan Phuong Dike Team for confirmation to trade in petroleum at the Tien Tan dike junction. Then, in August 1999, Mr. Nguyen Dang Tat established the Hong Giang private enterprise to trade in petroleum at the Tien Tan dike junction.
Mr. Le Van Duoc - then the Head of the Dike Team - confirmed as follows: Mr. Tat's family requested to open a gas station at km40+350 upstream of Huu Hong dike, 22m from the foot of the dike. Mr. Duoc requested the District People's Committee to consider and approve.
To clarify whether the Dan Phuong District People's Committee had approved the matter after requesting confirmation from the dike team, the reporter contacted the owner of Tien Tan gas station. Over the phone, the gas station representative admitted that there was no approval document.
The 1989 Dike Ordinance (effective in 1999) stipulates:
It is prohibited to build new or expand all types of structures within the protection area of dykes and other structures on riverbeds that cause unsafety to dykes or affect rapid flood drainage (Article 11).
(This provision is inherited in the 2006 Law on Dykes as follows: Prohibited acts include: Construction of works and houses within the dike protection area, except for works serving flood, storm and flood prevention and control, auxiliary works and special works (Clause 5, Article 7).
Currently, the act of building houses and works within the dyke protection area and riverbed area can be subject to administrative fines of up to 100 million VND depending on the severity of the violation (according to Article 32, Decree 03/2022/ND-CP of the Government). Violators of this act are also forced to restore the original state.
