Regarding the 2023 forest ranger uniform bidding package, the Provincial People's Committee said that the Forest Protection Department had previously failed to accept and liquidate Economic Contract No. 184/HDKT-CCKL because the contractor provided products that were not in accordance with the signed contract content. On that basis, the Forest Protection Department terminated the contract according to regulations.
After the contract was terminated, disputes arose between the parties and the case was filed with the Court. Quy Nhon City People's Court has accepted civil case No. 93/2024/TLST-DS on "Dispute over processing contract".
However, on May 9, 2025, the Quy Nhon City People's Court issued Decision No. 133/2025/QDST-DS on suspending the settlement of the case. According to this decision, Nhat Nam Trading and Construction Production Co., Ltd. (the plaintiff) withdrew its lawsuit, and the Binh Dinh Provincial Forest Protection Department (the defendant) also withdrew its counterclaim.
After the case was suspended, the Forest Protection Department and Nhat Nam Trading and Construction Production Co., Ltd. conducted negotiations to continue to implement the contract, and at the same time accept the product. However, this was not reported to the Provincial People's Committee, not in accordance with the direction of the Provincial People's Committee in Document No. 9376/UBND-TD dated December 10, 2023.
The Provincial People's Committee agreed on the principle of handling that any party that makes mistakes must be responsible according to regulations. In case the enterprise has fully overcome the shortcomings and errors as required by the contract and the product has been accepted and put into use, it will be considered for payment according to regulations.
Payment can only be made when the Forest Protection Department fully proves that the enterprise has correctly remedied the contract requirements; the acceptance process must ensure compliance with regulations, and at the same time have complete dossiers and relevant legal bases.
