On June 2, at the third session (specialized session), the 17th Hanoi City People's Council, term 2026-2031, passed the Resolution Regulating land policies for ethnic minorities living in Hanoi City.
According to the content of the resolution, residential areas, villages, and hamlets in ethnic minority areas are allocated and planned for community living land funds for ethnic minority people in accordance with customs, habits, beliefs, cultural identity and actual conditions of each region, with a minimum area of 300m2 or more.
The initial land support policy for individuals who are ethnic minorities belonging to poor and near-poor households in ethnic minority areas in Hanoi City (stipulated in Clause 2, Article 16 of the Land Law No. 31/2024/QH15) is implemented as follows:
- Land allocation within the limits prescribed by the City People's Committee and is exempt from land use fees.
- Allowing the conversion of land use purposes from other types of land to residential land within the residential land allocation limit prescribed by the City People's Committee and being exempt from land use fees for land originating from land allocation, lease, recognition or inheritance, donation, and transfer of land use rights by the State in accordance with the law.
- Leasing non-agricultural land that is not residential land without auction for production and business and is entitled to a 50% land rent reduction, unless otherwise provided by law; the area of non-agricultural land lease is decided by the commune-level People's Committee based on the actual situation and the local land fund.
The land support policy to ensure stable life for individuals who are ethnic minorities who have been allocated land or leased land by the State but now have no land or lack land compared to the limit but are poor households or near-poor households in ethnic minority and mountainous areas in Hanoi city is implemented as follows:
- In case there is no more residential land, residential land is allocated or permitted to change the land use purpose from another type of land to residential land within the residential land allocation limit prescribed by the City People's Committee and is exempt from land use fees. In case the area of residential land being used is smaller than the residential land allocation limit of the locality, it is allowed to change the land use purpose from another type of land to residential land within the residential land allocation limit prescribed by the City People's Committee and is exempt from land use fees.
- In case there are no more or the area of agricultural land being used is not enough 50% of the land area compared to the agricultural land allocation limit prescribed by the City People's Committee, agricultural land is continued to be allocated within the limit prescribed by the City People's Committee and land use fees are not collected or non-agricultural land is leased that is not residential land without auction for production and business and is reduced by 50% of land rent, unless otherwise provided by law; the area of non-agricultural land lease is decided by the commune-level People's Committee based on the actual situation and local land fund.
The resolution takes effect after 10 days from the date of adoption.
