On October 7, Huong Hoa District Party Committee (Quang Tri Province) confirmed that it is coordinating with Huong Hoa District People's Committee to resolve the case of re-appointing the principal position not according to current regulations for 1 case.
On August 14, 2024, the People's Committee of Huong Hoa district decided to re-appoint Ms. Do Uyen Thien Minh as Principal of Xy Kindergarten for a term of 5 years, starting from August 15, 2024.
The appointment decision is based on laws, decrees, decisions and Official Dispatch No. 921 dated August 13, 2024 of the Standing Committee of the District Party Committee on giving opinions on the reappointment of officials managing kindergartens and general schools under the District People's Committee.
The absurd thing is that Official Dispatch No. 921 clearly states that in the case of Ms. Do Uyen Thien Minh, she has held the position of Principal of Xy Kindergarten for 2 consecutive terms, therefore, the Standing Committee of the District Party Committee requested the District People's Committee to carry out the transfer and appointment, ensuring current regulations. However, the Huong Hoa District People's Committee still used that as the basis to re-appoint the position of Principal of Xy Kindergarten.
According to Huong Hoa District Party Committee, the reason the District Party Committee did not agree with the proposal to re-appoint Ms. Minh as principal is because at Point c, Clause 1, Article 22 of Decision No. 2178 dated August 13, 2020 of the District People's Committee stipulates that civil servants, leaders, managers, and principals of schools who have held positions for 2 consecutive terms at an agency or unit will be considered by the District People's Committee on a case-by-case basis to decide on re-appointment, transfer, or transfer of leadership positions to another unit.
In particular, at Point c, Clause 1, Article 10 of Circular No. 52/2020 dated December 31, 2020 of the Ministry of Education and Training on promulgating the Charter of kindergartens stipulates that the principal working at a public school cannot serve more than 2 consecutive terms. Therefore, the appointment of Ms. Minh as principal for more than 2 terms at a school is not in accordance with current regulations.
Huong Hoa District People's Committee said that at the time of re-appointing Ms. Minh, Xy Kindergarten was preparing to receive a national standard school, and in 1 year Ms. Minh herself would be able to meet the requirements to be considered an Excellent Teacher. The District People's Committee chose the re-appointment option so that Ms. Minh could receive a national standard school, then transfer her away.
It is known that the ceremony to receive the national standard school at Xy Kindergarten took place on the opening day of September 5, 2024, but until now, Ms. Minh has not been transferred to another school.
“After the reappointment, the leaders of Huong Hoa District People's Committee reported back to Huong Hoa District Party Committee. We still maintain our stance of not reappointing Ms. Minh for more than 2 terms according to current regulations, and require that the regulations be implemented properly,” informed Mr. Nguyen Tang, Secretary of Huong Hoa District Party Committee.
