As Lao Dong Newspaper reported, in Thong Nhat Ward, Hoa Binh City, Mr. Vu Cong Tuyen's unlicensed factory with an area of over 300 square meters, of which 15 meters of frontage on National Highway 6, has been built for many years.
It is worth mentioning that for more than a year since the discovery of the existence of an illegal factory thanks to the excavation of the road slope to widen National Highway 6, Thong Nhat Ward is still confused about how to punish it. Mr. Tuyen's factory land is located only about 100m from Thong Nhat Ward People's Committee and is accused of encroachment.
According to local residents, this factory of Mr. Vu Cong Tuyen's family was built in 2022. Previously, the factory was used as a car repair garage for rent. However, recently, that garage has moved to another location.
Report of Thong Nhat Ward People's Committee, on May 31, 2023, Thong Nhat Ward's violation handling team inspected and discovered that Mr. Vu Cong Tuyen's household had arbitrarily built a steel-framed factory with a corrugated iron roof with an area of 256 square meters.
The factory's location is 27.6m from the center of Highway 6. The temporary status is determined to be that the violating factory belongs to two plots of land number 312 and 79, TBD number 13, garden land type.
At the meeting, the working group requested Mr. Vu Cong Tuyen to dismantle the illegal construction and restore it to its original state. However, to date, the construction has not been dismantled.
Regarding the accusation of encroachment on land of adjacent households, the People's Committee of Thong Nhat Ward said that in June 2023, the ward received a petition from Ms. Do Thi Dung, representing 3 households (including Ms. Do Thi Dung, Ms. Nguyen Thi Lieu and Mr. Do Van Tuan) bordering Mr. Vu Cong Tuyen's land plot, accusing the factory of encroaching on land.
"Immediately after that, the ward requested the households to measure to determine the boundary markers between the land plots in order to have a basis for settlement. Ms. Dung requested the Branch of the Land Registration Office of Hoa Binh City to set up boundary markers for Ms. Dung and Ms. Lieu's land plots. By July 2023, this unit sent a document to Ms. Lieu and Ms. Dung informing them that the dossier was not eligible for settlement, because the boundary and boundary markers with adjacent households had not been agreed upon" - the report of Thong Nhat ward clearly stated.
Explaining the reason why it is still not possible to impose fines and request the factory to be dismantled, in an interview with Lao Dong Newspaper, Mr. Pham Anh Quy - Chairman of the People's Committee of Hoa Binh City - said that the authorities are urgently verifying the origin of the land.
According to Mr. Quy, due to the current complicated overlapping of land origins, the Urban Management Department is coordinating with the Department of Natural Resources and Environment of Hoa Binh City to verify the land origins and have a basis for handling.
"Hoa Binh city's viewpoint is to resolutely handle the issue to clarify it, including handling illegal factories and denouncing land encroachment," Mr. Quy clearly stated.
On the same day, information from the Department of Natural Resources and Environment of Hoa Binh City said that the unit is continuing to urge Thong Nhat ward to carry out measurements and determine boundaries to promptly resolve the matter.
Also according to Mr. Bui Hong Quang - Vice Chairman of Thong Nhat Ward People's Committee, the leader of Thong Nhat Ward People's Committee, the ward has submitted an application to invite the Hoa Binh Province Land Registration Office to determine the boundary markers. It is expected that the marker planting work will be carried out at the end of December.
