According to Decree 168/2024/ND-CP, at Point h, Clause 9, Article 7 stipulates: "Sitting behind your arms through the person sitting first to control the car, except where children under 06 years of age are sitting in front". fined from VND 8,000,000 to VND 10,000,000 and deprived of the right to use the driver's license from 10 to 12 months as prescribed at Point b, Clause 12, Article 7, applicable to motorcycles, motorbikes, Vehicles similar to motorcycles and vehicles similar to motorbikes.
In addition, according to Point b, Clause 10, Article 7, if the above behavior causes a traffic accident, the fine will increase from 10,000,000 VND to 14,000,000 VND, and be deducted 10 driving licenses as prescribed. At Point d, Clause 13, Article 7, applies to motorcycles, motorbikes, vehicles similar to motorcycles and similar vehicles.
Thus, according to the above provisions, the driver is only allowed to carry children under 6 years old sitting in front of the motorbike. The transportation of children 6 years of age and older sitting ahead is a violation of the law.
