The Ministry of Construction issued Document No. 6412/BXD-KHCNMT&VLXD on guiding the implementation of registration of conformity assessment activities, certification and declaration of conformity for safety equipment for children used in cars according to QCVN 123:2024/BGTVT.
The Ministry of Construction said that before July 1, 2026, the declaration of conformity for child safety equipment used in cars will be carried out according to QCVN 123:2024/BGTVT.
According to section 3.1.2 of the Regulation, safety equipment for children must be declared to be compliant at the local specialized agency where the organization or individual registers for production and business activities, based on the conformity certification results of the certification organization designated by the Vietnam Register in accordance with regulations.
From July 1, 2026, the management of product and goods quality will be implemented according to Law No. 78/2025/QH15 amending and supplementing a number of articles of the Law on Product and Goods Quality and Decree No. 37/2026/ND-CP.
Accordingly, products and goods are managed according to three levels of risk: Low, Medium and High; quality management measures, requirements for conformity certification and certification performers are determined corresponding to each level of risk.
During the time, the Ministry of Construction promulgates a list of risk classification levels for products and goods under its management, organizations and individuals producing, importing, and trading safety equipment for children used in cars and conformity assessment organizations need to proactively prepare conditions, capacity, and dossiers to carry out certification and declaration of conformity according to QCVN 123:2024/BGTVT as soon as there is sufficient legal basis and organize conformity assessment of sufficient conditions.
The conformity assessment organization that needs to conduct testing and certification activities for child safety equipment used in cars according to QCVN 123:2024/BGTVT is responsible for reviewing capacity, operating scope, human resources, testing equipment, quality management system and business conditions for conformity assessment services according to the provisions of the Investment Law, the Law on Standards and Technical Regulations and Decree No. 22/2026/ND-CP dated January 16, 2026 of the Government.
Organize the assessment of conformity for registration of testing activities, certification according to QCVN 123:2024/BGTVT at the local Department of Construction where the head office is located according to the order and procedures specified in Decree No. 22/2026/ND-CP.
After being granted a Certificate of Registration of Activities in accordance with the scope of QCVN 123:2024/BGTVT, organizations that need to be appointed to perform conformity certification send dossiers to the Vietnam Register Department for consideration and appointment according to their authority and according to the regulations of QCVN 123:2024/BGTVT.
In case the product is classified at the average risk level according to the list issued by the Ministry of Construction, conformity certification is carried out by a certified organization as recognized by regulations.
In case the product is classified at a high risk level, conformity certification must be carried out by a certification organization designated by a competent authority.
Conformity assessment organizations need to monitor risk classification lists to properly implement corresponding management requirements.
Organizations and individuals producing, importing, and trading safety equipment for children used in cars are responsible for fully researching technical requirements, conformity assessment methods, conformity declaration dossiers, labeling and post-conformity declaration responsibilities according to QCVN 123:2024/BGTVT and laws on product and goods quality.
Before putting products on the market, businesses must carry out conformity certification and declaration of conformity in accordance with regulations; select testing and certification organizations with operating scope consistent with QCVN 123:2024/BGTVT and meeting the requirements for recognition and designation corresponding to the level of risk of the product.
Businesses are responsible for the legality, completeness, accuracy of dossiers, technical documents and product quality put on the market.
The Ministry of Construction requests the People's Committees of provinces and cities to direct the Department of Construction and relevant specialized agencies to organize the receipt and settlement of dossiers for registration of conformity assessment activities according to QCVN 123:2024/BGTVT of conformity assessment organizations in the area in accordance with the provisions of Decree No. 22/2026/ND-CP; and at the same time receive dossiers for declaration of conformity for safety equipment for children used in cars according to regulations.
The Ministry of Construction assigns the Vietnam Register to prepare professional conditions, guide the dossier components and organize the receipt and processing of designated registration dossiers of certification organizations to comply with QCVN 123:2024/BGTVT according to their authority; ensure that the consideration and designation are carried out publicly, transparently, and in accordance with regulations, promptly meeting the needs of enterprises for conformity certification when organizing the conformity assessment to fully meet the conditions.
