An Giang voters propose that students from 16 years old can take the driver's license exam, because in reality, they have developed more physically and many students have to drive their own to school because their homes are far away.
After studying, the Ministry of Construction responded as follows:
Regarding driver training. According to the provisions of Clause 1, Clause 4, Article 56 and Clause 1, Article 59 of the Law on Road Traffic Order and Safety, people aged 16 and over are allowed to drive motorbikes (including students).
The Law on Road Traffic Order and Safety and Circular No. 14/2025/TT-BXD dated June 30, 2025 of the Minister of Construction regulating driver training, fostering, testing, and granting certificates of training in road traffic law do not limit people aged 16 and over to learn to drive.
Regarding testing and issuing driving licenses
According to the provisions of the Law on Road Traffic Order and Safety: Point a and Point b, Clause 1, Article 57 stipulate the driving license classes as "class A1 granted to two-wheeled motorbike drivers with a cylinder capacity of up to 125 cm3 or with an electric motor capacity of up to 11 kW; Class A granted to two-wheeled motorbike drivers with a cylinder capacity of over 125 cm3 or with an electric motor capacity of over 11 kW and vehicles specified for an A1 driving license"; at Point b, Clause 1, Article 59, stipulates the age of the driver "A person aged 18 years or older is granted a driving license of class A1, A, B1, B, C1, and is granted a certificate of training in road traffic law to drive specialized motorbikes participating in road traffic".
According to the provisions of the International Convention on Road Traffic in 1968 to which Vietnam is a member: Section 8 and Section 9, Appendix 6 of the Convention stipulate that Vious types included in driving licenses include: A. Motorbikes; A1. Motorbikes with a capacity not exceeding 125 cm3 and an engine not exceeding 11 kW"; Point b, Clause 4, Article 41 of the Convention stipulates that "... the participating parties may not recognize in their territory the validity of a driving license for a person under 18 years old".
Accordingly, the International Convention on Road Traffic in 1968 also does not encourage the issuance of motorcycle driving licenses to people under 18 years old.
Implementing Conclusion No. 121-KL/TW dated January 24, 2025 of the Party Central Committee on summarizing the implementation of Resolution No. 18-NQ/TW of the 12th Party Central Committee on a number of issues on continuing to innovate and reorganize the apparatus of the political system to be streamlined and operate effectively and efficiently, the Government issued Decree No. 02/2025/ND-CP dated February 18, 2025 stipulating the functions, tasks, powers and organizational structure of the Ministry of Public Security, Decree No. 33/2025/ND-CP dated February 25, 2025 stipulating the functions, tasks, powers and organizational structure of the Ministry of Construction.
Accordingly, from March 1, 2025, the Ministry of Public Security has received and implemented the task of state management of testing and issuing driving licenses.
