The Ministry of Construction is seeking opinions on the draft Circular regulating the order and procedures for inspection and exemption from initial inspection for motor vehicles and specialized motorbikes; and at the same time supplementing regulations on emission inspection of motorbikes and mopeds.
One of the new points of the draft is to supplement regulations on data on violating vehicles (Article 27) as follows:
The violating vehicle is a vehicle in the case of being refused inspection specified in Clause 1, Article 43 of the Law and the case where the vehicle's inspection results do not meet.
Method of posting and removing violating vehicle information.
The violating vehicle is posted on the inspection management software of the Vietnam Register.
Vehicles posted with violating information are removed from the violating information immediately after the inspection results meet the requirements or there is evidence of remedying the violating content;
Organize the implementation of posting and removing information of violating vehicles:
The Department of Construction shall carry out the posting and removal of vehicle violation information for the following cases: at the request of procedural agencies in the locality; when vehicle owners have not completed the request of competent state agencies on resolving administrative violations in the field of road traffic order and safety at the request of functional agencies in the locality.
Registration facilities carry out registration and removal of vehicle information that violates for cases: information shown on the vehicle registration certificate is not consistent with the license plate or with the actual vehicle when carrying out inspection procedures; has not re-issued the vehicle registration certificate at the next inspection after the vehicle has been granted the renovation certificate; there is a basis to verify that the vehicle owner forged documents and papers of the vehicle; the vehicle has inspection results that do not meet standards.
The Vietnam Register Department performs the posting and removal of vehicle information violating regulations at the request of the central prosecuting agency.
Comparing the provisions of Clause 1, Article 43 of the Law on Road Traffic Order and Safety as follows: Responsibilities of registration establishments, owners of motor vehicles, specialized motorbikes and drivers of motor vehicles, specialized motorbikes
Registration facilities are public service providers that perform technical safety and environmental protection inspections for motor vehicles and specialized motorbikes organized and operated according to the Government's regulations.
Registration facilities are responsible for the results of technical safety and environmental protection inspection of motor vehicles and specialized motorbikes; refuse inspection of violating vehicles when vehicle owners have not completed the request of competent state agencies on resolving administrative violations in the field of road traffic order and safety.
According to the Ministry of Construction, the addition of the above content is to be consistent with current legal regulations, to concretize the responsibility of implementing Clause 1, Article 43 of Law No. 36/2024/QH15.
