According to the regulations in Decree 100/2019/NĐ-CP (point i, point k, clause 2, Article 6), the authorities will fine from 200,000 VND to 300,000 VND for any of the following violations:
The driver or passenger on the vehicle does not wear a "helmet for motorbike and motorcycle riders" or wears a "helmet for motorbike and motorcycle riders" without fastening the strap properly while participating in road traffic.
Decree 123/2021/NĐ-CP amends Decree 100/2019/NĐ-CP to adjust this regulation as follows: Motorbike and motorcycle drivers who do not wear a helmet with the strap properly fastened will be subject to administrative fines ranging from 400,000 VND to 600,000 VND.
Meanwhile, in the Draft Decree on administrative penalties for traffic order and safety violations in the road traffic sector; point deduction and license point recovery will take effect from January 1, 2025. (point n, point o, clause 3, Article 8) stipulates, fines ranging from 400,000 VND to 600,000 VND for drivers committing any of the following violations:
Not wearing a "helmet for motorbike and motorcycle riders" or wearing a "helmet for motorbike and motorcycle riders" without fastening the strap properly while driving on the road.
Carrying passengers who do not wear a "helmet for motorbike and motorcycle riders" or wear a "helmet for motorbike and motorcycle riders" without fastening the strap properly, except in cases of transporting sick people for emergency, children under 06 years old, or escorting law violators.
