The Ministry of Public Security is seeking comments until October 1, 2024 on the Draft Decree regulating administrative sanctions for violations of traffic order and safety in the field of road traffic; deduction of points, restoration of points on driving licenses.
Article 35 of the draft stipulates penalties for drivers of motorbikes, mopeds (including technology-based motorbike taxis), and rudimentary vehicles who commit violations in transporting passengers and goods as follows:
A fine of VND 400,000 to VND 600,000 shall be imposed for one of the following violations:
Carrying more people than the vehicle's capacity allows.
Carrying more goods than the vehicle's permitted weight or loading goods on the vehicle beyond the prescribed limit.
Transporting bulk goods, construction materials, waste that may fall onto the road or cause noise or dust.
Loading goods in front of and behind a vehicle without red flags at the starting and ending points of the goods when the vehicle is operating during the day; loading goods in front of and behind a vehicle without lights or other signals at the starting and ending points of the goods when the vehicle is operating at night or in the dark.
A fine of 300,000 VND to 400,000 VND shall be imposed for one of the following violations:
Arranging or tying goods in an unsafe manner or causing danger to people and vehicles participating in traffic; arranging goods in a manner that obstructs the driver's vision or obscures the vehicle's lights or license plate; dropping goods from the vehicle onto the road.
Not checking the vehicle's safety conditions before participating in traffic.
Technology motorbike taxi drivers need to pay attention to complying with legal regulations when transporting passengers or goods to ensure safety and avoid being fined.
