Discussing this issue with Lao Động, Lawyer Nguyễn Tình, Deputy Director of Tinh hoa Việt Law Firm, stated that the regulation of deducting points from a driver's license is a new regulation.
Currently, the Ministry of Public Security is drafting a draft Circular regulating the organization of checking knowledge of traffic law and road safety to be eligible for restoring points on a driver's license.
The scope of application of this circular regulates the organization of checking knowledge of traffic law and road safety for individuals who have had their driver's license points deducted to be eligible for restoring points on their driver's license.
Article 6 of the Draft Circular stipulates the implementation of registration and checking knowledge of traffic law and road safety as follows:
The subjects specified in this circular shall submit a request in the prescribed form attached to this Circular and a health certificate issued by a competent medical authority that is still valid, to the competent authority specified in this Circular to request checking knowledge of traffic law and road safety in one of the following forms: Submit in person; via postal service; hire a service from a business or individual; submit online at the National Public Service Portal or the Provincial Administrative Procedure Information System.
The competent authority shall check after receiving the request and shall notify the person who submitted the request of the time and location of the knowledge check of traffic law and road safety.
In the case where the person submitting the dossier directly requests to participate in the check on the same day, the agency implementing the check shall receive the request and shall be responsible for arranging the check in accordance with the request. The organization of checking knowledge of traffic law and road safety shall be conducted on working days of the week.
The person participating in the check shall be present at the specified time and location and present their driver's license to the checking officer, except in cases where the driver's license has been integrated into the national identification application.
Log in to the knowledge check software of traffic law and road safety and perform the content of the check in accordance with the guidance of the checking officer.
After completion, the person taking the check shall sign a check report of knowledge of traffic law and road safety printed from the knowledge check software of traffic law and road safety in the form prescribed in this Circular.
